    I wonder in a few more years time they will still be saying "oh it takes time"

    The fact is he has won, he has got away with it.

    Everything they threw at him failed, its still there.
  • It may well take years. That is the speed of the legal system, not the fault of the Planning Department.

    Its already taken years.

    Last May was once again this is it finally it has to come down. There has been many times like this and there will be more in the years to come.

    All the time Mr Fidler and his family are living there rent free.

    I'm sorry to sound so aggressive, but have you read the rest of this thread, or do you just not understand????

    Of course he hasn't won, what an ignorant attitude.

    He lost his planning appeal, he lost his High Court appeal, he has one final appeal underway to the European Court of Human Rights (I think that's where he's appealed!) - and once that final appeal has been also lost, then he will have to demolish it. I can't give a timescale on this appeal (and neither can anyone - it depends entirely on the speed of the appeal process, which is notoriously slow). However, once the appeal is lost, he will have to demolish it... that may take a few months, it may take a lot longer - I have no idea!

    And what on earth do you mean by your phrase "Everything they threw at him failed" - EH????? Exactly the opposite is true - every appeal he has tried, HE HAS LOST!!!! The planners must be laughing at him - all the stress it must be causing him, with all his failed appeals...

    I'll try and be nice now... please try and have a basic understanding of the relevant issues before repetitively posting things along the lines of... it's still there, he's won... etc etc... nothing could be further from the truth and it's like listening to a whinging child.
  • Planning Officer is quite correct, Mr Fidler has failed at every turn and the place WILL eventually have to be demolished, but at the moment is still going through yet another appeals process, which is his legal right.

    Eventually there will be nowhere else to appeal to and then the place will have to come down. He will be given a period of time in which to do this, which could be months.

    So how come the "Granny Flat Battle" had to be demolished cause it was only a few feet too big? (Mail yesterday)

    I read that story yesterday - it was more than a couple of feet too big - it was 1 metre wider on one side and 4 metres longer on the other side. From the look of the picture on the article that would have just about doubled the size of the extension!! Typical Daily Mail story making it sound like evil council destroying the granny's home when really it was an enormous breach ofr the planning permission.

    The amusing part was all the mathematically inept comments underneath from people who clearly had no idea how big a metre is and reckoned that adding 1 and 4 metres to the side only added 4 square metres to the overall floor area!!

    That extension was built in 2004, so again - it was a lengthy process before it got demolished. This highlights that the appeal process is extremely slow, but the end result is the same - it just takes a while to get there!
