I've just queried how they can take the extra money from my card that I haven't authorised....even though I sent them an email within a minute of them sending me the despatch email with extra £15 on top saying I wouldn't pay that much
first of all got told that there is a backlog on the emails (of 11 days!!)....and then got told i should have phoned to cancel >:(
queried the legality of what they'd done and was put on hold while he read the t&c's to find the relevant bit...when he came back he said nothing about the t&c's and just kept assuring me it was perfectly legal....does anyone know if they're are allowed to do this??0 -

I very much doubt it is legal. Contact your local trading standards office and discuss it with them!0 -
Further to that
Misleading prices
It's a criminal offence for traders to make misleading price claims. 'Was £120. Now £99.99!' is misleading if the goods were never provided at the higher price. It's also misleading if a trader fails to show 'hidden extras' or to make it clear when a price is conditional on, for example, another purchase.0 -
What about the illegality of charging you for an item and providing you with an inferior quality alternative item without any attempt to inform you or forewarn you of the same! >:(0

Couple this with the fact that they are STILL advertising the phone as an e616V on their current home page http://www.carphonewarehouse.com
Have they now miraculously found new stock having conned us all by sending us aged e616 's ?... or are they expecting to con a few more!?
They should be taken to task on this!0 -

apparently "3" have run out of e616v's and they are just repackaging the e616's with updated software and new battery....this isn't just carphone warehouse specific by the way0

Whoever told you that was talking b*******
How can you upgrade the camera? its hardware dependant... and the batteries I received with mine (and many others here too!) were the older lower capacity types which can only be recharged whilst on the phone.
NEC obviously introduced the e616V to address issues with the original e616 such as poor video quality and poor battery life, lets face it we have been fobbed off with a load of crap, buts whats even more annoying is the fact that they tried do do it in such an underhanded way, hoping nobody would notice! >:(0 -
that was the official word from 3. i agree with you that it isn't strictly true, but i was also pointing out that this isn't specific to carphone warehouse, apparently all new "e616v's" will be like this at the moment :-[0
