What is the usual period of time before these companies give up? I've been getting letters since before New Year and they've only just changed the debt collection company now! I've been binning everything I get from them and I would have thought that if they were actually serious about taking me to court that they would have done it by now? Its been over 6 months. Has too much time not elapsed for them to do that?
I believe they have 6 years to take you to court, however it's been 6 months so the chances of them actually following though with their threats are the same as Blackburn winning the premiership this year (ie zero).
You should keep the paperwork to show to friends/family/work collegeues as examples to what they can expect if they get invoiced0 -
If they are sending it via business class mail, then pop it back into the post-box and they get charged for it again0

Ignored the previous letters from UK Parking Control and Debt Recovery Plus blah blah blah, as you suggested, thank you very much!
A few days ago received a notice of intended litigation. Not really sure what this means. It states in the letter to visit their website debtrecoveryplus.co.uk to see a selection of CCJs they have obtained. Worth a look. There's no real details there, just names and numbers.
What do you reckon to this?

It's the standard next step in the campaign to intimidate you into paying.
The more unpleasant threats usually include mentioning that, if the case goes to court, a county court judgement (CCJ) will be issued, that bailiffs will be appointed and that your credit rating will be ruined. For things to actually get to this stage, the car park owner would have to take you to court and win the case. Then, you would have to refuse to pay, to get a CCJ issued after 28 days. Then, you would have to still refuse to pay, to get bailiffs appointed.
They omit to mention the recent landmark court cases, VCS Parking Control vs. Ronald Ibbotson, S!!!!horpe, 2012, HM Revenue & Customs vs. VCS Parking Control, Lower Tax Tribunal, 2012 and VCS Parking Control vs. HM Revenue & Customs (Appeal), Upper Tax Tribunal, 2012. In these cases, the judges ruled that only the car park owner can charge for parking and take alleged offenders to court. The Upper Tax Tribunal is equivalent to the High Court, and therefore its judgements set legal precedents.
We've seen the DR+ list of cases and checked the case numbers. It contains judgements they've obtained for their other work, mostly council tax arrears and also default judgements, where the cases weren't defended, probably because the defendent never received the court papers.The acquisition of wealth is no longer the driving force in my life.0 -
stuff and nonsense, unless you want to play games, or go after the people who allowed the company to opperate, ignore everything, with one big exception and that is a genuine court claim form.
Ok that may sound worrying, but its not the cances of getting one of those is tiny, and even then the chances of them winning/getting anything against you are even smaller - unless they can get a default judgement ( caused by ignoring the one and olnly important form/letter) and then add you to their victory list on their website.
Again ignore everything, if in doubt ASK and post on here each time you recieve something.
if you want them to stop threatening you/harrasing you you can also find plenty of advice on hoew to stop them here as well.
keep us informed, as your expieirince will help other people who will find themselves in a simalry situation.
