    Because pofa 2012 has been discussed for at least two years, private parking rely on contract law and not on legislation like councils or the police use. And the only way this can have any affect on your credit rating is for it to go to court, they win the case and you fail to make payment within 28 days. This is a matter of public fact.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    As mentioned, we have been talking about this for two years. When the Bill was first put forward we scrutinised it and have done ever since it became law in October. And we were not the only forum to come to the same conclusion, that it was all smoke and mirrors with the best bit being the criminalisation of private clamping/towing. So the law was a good thing in that way, but the PPCs have hijacked it as we knew they would, to make out it is something it isn't.

    Obviously the BPA has sent a press release to the AA!

  • Hi all, I got a ticket from UKPC after parking for 30 minutes in Aylesbury shopping centre. My hire car had been giving trouble so I let it sit while I went and got a quick bite to eat. The ticket was on the screen when I got back. The first 2 hours are free but you have to display a ticket, I missed that bit. I did try to appeal to UKPC but as always they don't do appeals and proceeded to up the fine if not paid within 10 days. After reading many of the posts on this site I decided not to pay and sent the below letter to them. Not heard a word since. They may have changed their tactics since then but the principle remains the same.

    I am disappointed that you have declined to cancel the “charge” and I have taken legal advice as to whether this fine is enforceable by UKPC.

    Advice is that it is the car park owner and not its agents that has any legal authority to enforce payment of the fine, and only then if the car park owner has lost financially as a result of my not displaying a ticket in my car. As I was only in the car park for about 30 minutes in total and the first 2 hours parking is free, any financial loss would be difficult to prove by the car park owner.

    In these circumstances, and as I do not believe the fine is warranted for the reasons stated in my letter, I do not intend to pay this fine.

    Any further action by UKPC in this regard will be regarded as harassment under the terms of the Protection from Harassment Act 1997. I am copying this letter, together with my letter of appeal to the car park owners.

    They will turn that down flat, they want your money and everytime you contact them they think that they have a chance of payment. It's good you are writing to the landowner though, as they would be the ones responible for the actions of these clowns!

    And by the way it's not a fine or penalty, just a lousy invoice requesting or begging to be paid.

    I see that you still breaking forum and BPA rules by not declaring your company name. Why is that?
