I'm 2 years in now and no ccj's. Two default notices but they weren't even passed on to debt collection agencies. Only one has gone to DCA.
Never hear from anyone anymore (sniff) except some that send me the statements.
Only one is charging interest - at 1% above base so very low just now. The rest all stopped interest and charges after 3-4 months and never started it up again.
Wow! Are you able to let me know how much u owed and how many creditors?
I start dmp in june and am a bit worried about CCJ's and charging orders and such like
Sounds like you have a bit of a result,we currently owe £45k spread over 10 creditors and am hoping we dont get CCJ's....0 -
Has anyone ever added a debt to their cccs plan after a month or so of starting. My husband has a debt which I didnt know about that I need to add to the plan, Its only £325 but I just wondered what cccs are like when it comes to having to add something. I can also up our payment by £10 a month though, so our outgoings will be a tiny bit less etc..0

For various reasons (mainly work) i'm not going to be calling the CCCS until Tuesday, does this mean that I won;t pay the CC's that are due end of may/beginning June and that my first payment to the CCCS will be 1st July?
Just another thing for me to get my head around!

Loking through your recent posts, I think you need to see how much debt you actually owe and see what you can claim back through charges and mis-sold ppi.
Have a look at the reclaiming section of the site for advice and guideance on reclaiming these. There are template letters to send to your creditors.
Remember, if you have had any previous credit agreements with ppi attached that have now finished, you can still try and claim back this too. Its easier if you still have the paperwork for these though.
Next thing is to request a copy of the original credit agreements for your current debts. This is known as a CCA request. This way you can see if any of your debts are unforceable meaning that the creditor would be less likely to take you to court for non payment.

In a nutshell, this route can stop your creditors hasselling you for payment. Basically, you request the CCA enclosing the £1 statutory payment using the template letters on the site. Your creditor has 12 working days to provide you this document. If they dont then the account automatically becomes "in dispute" meaning the enforcement action is not permitted. Creditors rarely comply as the vast majority of pre April 2007 agreements do not comply with legislation, meaning that they are unenforceable by a court. This should mean that a CCJ or charging order etc cannot be granted against the debt.
I must stress though that it isn't as simple as it seems. Creditors usually wont give up without a fight and usually ignore the rules and still try to enforce the debt. However some people do get replies back saying that the creditor will no longer be persuing the debt. This will still probably stay on your credit file for 6 years though.
You need to get the ball rolling ASAP on this. Follow the advice and when your creditors reply, post again the the above thread for advice on what to do next. They will be always someone who can assist you on there and some who know a lot more on the subject than me.
Remember, they cant have what you haven't got and you can always come on here for advice and guideance with your debts whenever you want. We are all in the same boat on this thread and have all felt really low at some point about the money we owe. You will get through it!

I called CCCS in early March, got the stuff sent back out to them by return and started my DMP on 1st April, so it can be set up very quickly (assuming there are no queries/unusual circumstances, I suppose). This meant in practice that I paid a token payment (£1 each) to my creditors for their March statements, and then paid CCCS my amount on 1st April, and they paid my creditors on 25th April.
Does that help?

Devongirl - I can't get my head round it sorry not usually this dense! Does that mean that i will pay token payments for may statements (all due from 30th may onwards) then i can save for a rainy day what i would usually pay my creditors, then the June statements (due from 30th June onwards) would be paid via CCCS?0

Yes, I think that's right... So you'll get your creditors' statements about mid-May, ahead of the direct debit/due payment date of around 30th May onwards - so, cancel the associated direct debits and make token payments via Postal Order etc so you are paying something to them. CCCS will send you a template letter 'notice of arrangment of a DMP' (or something..) which you photocopy and include with each payment. Then, at the start of June (if it can be arranged that quickly) you pay your amount to CCCS, which they then distribute to your creditors for the June statments. Does that make sense? Um... effectively not, which is why I could only afford £1 token payments to my creditors at the start, as I had my CCCS payment coming out on the 1st of the month.
Please don't take my word for this though - was only offering advice after my experience - give CCCS a ring so they can tell you for sure.LBM - March 2009, DMP Start - April 2009
