    Very quiet on here today. Everyone getting ready for the Easter break??

    A couple of questions.

    1. WHen I make my second token pyts do I need to send out the letters again to all the creditors?

    2. Also our account was with Nationwide and we have a £2500 overdraft which is included in pur DMP, we now have an account with the co-op and most of the D/D's are now being transferred. THe question is do I actually have to write a letter and asked for the Nationwode account to be closed? the account is obviously 2500 overdrawn, or do I just leave it as it is and not use it anymore?? Not sure what to do?
    Could anyone advise me please.

    If you want to, I don't suppose it could do any harm at least you could feel safe that you have informed your creditor, don't waste money on expensive postage though.

    Leave the account as it is, the bank wouldn't close the account unless the arrears have been cleared anyway, when you have set up the DMP I doubt you'll be using the account again

    I have a quick query and was wondering if anyone could advise?

    I'm doing a joint DMP with my hubbie as I don't currently work and have another year of study before I will be earning again. His creditors have been fab - accepted reduced payments and frozen interest and charges (All except B'card but that's a whole other story ;).) A couple of mine, however, are being particularly awkward.

    Would it be worth reminding them that my husband is not legally responsible for my debts and that, should they keep being difficult, I will separate my finances from his so that basically they'll get b****r all? I don't want to do this but I'm fed up with paying interest and charges and my hubbie would get his debts cleared up so much quicker if he wasn't paying mine too.

    Any advice appreciated,

    Hi Cornish Maid, sorry your creditors being difficult it really is frustrating isn't it? You begin to wonder why you bother trying to sort yourself out and feel like jacking it all in. I think many of us feel the same at some point :rolleyes:

    can I ask who are your creditors? Not that it makes much difference but you could try and claim some of the charges back. Being on a DMP isn't legally binding like an IVA or bankruptcy so the creditor still has the right to charge it, I know it's bloody frustrating isn't it?

    Have you tried the CCA route? I know some use it to see if a debt is enforceable (avoid the ccj route). I asked for CCA's on ours and not one has come back with the proper stuff BUT it seems to have stopped some creditors with charging interest and charges. Halifax did straight away, could be worth a try ;)

  • Thanks everyone for the advice over the overpayments. Not having the CCs for emergencies is a major reason to stock up this cash and make an annual offer of an over payment!

    Can someone explain the CCA thing to me please? Don't even know what they are but everyone is talking about them........

    Have had a letter from Nationwide :T they are accepting my reduced payments on the loan. Was worried about this one as it is my single biggest debt and the payments have been cut by cccs to half eek! But they have accepted for a year. It doesn't say anything about freezing interest though....it also says the arrears will build up as I am making reduced payments, does that just mean that obviously the loan won't be paid off in the original timescale? The arrears figure shown on my letter shows my full monthly payment minus my token payment so my full monthly payment includes interest so that does mean they are not freezing interest?


    Had a bizarre letter from Aqua credit card acknowledging receipt of my letter - which is my notification of dmp, no mention of the proposal that cccs have sent out - it says we confirm the direct debit facility on your account has now been cancelled (I cancelled this anyway plus there are no funds in the old account that it came out of) and please continue to make payments by the statement date. ???? No mention of dmp/reduced payment/freezing interest. Any ideas??

    That's now 3 responses out of 10 that I have had...I wonder if they are all waiting until after the 25th to see if they actually do receive payment from cccs?

    Hi All,

    Haven't had a chance to come on here for a while. There's been lots happening my end. OH has been made redundant (again) and we are just about managing with the rent and c-tax as he has found some short term retail work but come May the brown stuff may well and truly hit the fan. I hope that we can stay here but who knows. On the positive side I have managed to get a new job which I know in the current climate is quite rare but I went for it a while back, they took around 3 weeks ish to get back to me finally but that means I may have slightly more to pay back possibly, although with petrol rising again and a longer commute now I may need some more. I have a review in a few weeks. Everything creditors wise seems to be ticking along nicely. I haven't got round to doing letters yet to claim back charges but am going to try and do that this week. My Mum has offered to possibly loan me some small amounts to f&f offer the lowest amount of debts I have but not sure how to go about this- Do I go in with a 30% of the final debt amount offer first and go from there? Any advice would be greatly appreciated!

    Another question also. My car is still going but just had to pay out £300 to replace the clutch- thankfully I had a little bit in the pot and a helpful Mum again but I think although it's not ancient (52 reg) I don't think it has much left to give maybe another 15-20000 miles if possible. I can do a lot of driving for work and get to claim petrol for work related stuff but I'd like to know if there is anyway or possibility of being able to get a car whilst on a DMP bar saving for a 1000 years to have enough! I was going to discuss this when I have my review but I just wondered if anyone in the same position could offer any advice?

    Hi Toffee Penny.

    Between the 2 of us we have: Sky Card, Barclaycard, Capital One, Egg & Halifax. Here is a breakdown of our DMP adventures so far! :o

    Capital One (me): accepted immediately reduced payments and have suspended interest & charges for a year.

    Halifax x 2 (myself & OH): have accepted for 3 months, stopped charges & reduced interest to 6%. Have also said that if circumstances have not changed after this, they will put us on a long term repayment plan without defaulting us???

    Skycard (hubbie): originally accepted for one month with continued interest but, after one more letter, have accepted reduced payment for 6 months and suspended all interest & charges!

    Skycard (me): had the same one month acceptance letter but have not been offered 6 month extension nor suspension of interest! In addition have had £12 default fee added even though action on my account was supposed to be halted for one month. 6th letter sent today! (Also, I owe them less than a third of what OH does - where is the logic??!!)

    Egg cc/loan (both mine): have had no personal response to my three letters and one phone call (done against my better judgemant and only served to prove to me how incompetent they are!) Have had constant calls, letters & e-mails from them (all of the standard variety) with various threats. Sent a strongly worded e-mail today and when I logged on to view the response found that they have blocked my online access! Of couse, they want me to phone to reset it - fat chance! :rotfl:

    Barclaycard (hubbie): well what can I say? We owe them the least of all and have had most trouble from them. Despite 5 letters, 2 specific phone harassment letters & 1 CCA request they WILL insist on calling. They were harassing my hubbie at work until they were told that legal action would be taken against them for obstructing a business phone line - that seemed to work! So they stepped up the calls to our home - no calls today but yesterday & the day before there were some periods where they phoned at 2 minute intervals. (We have never answered at home but are keeping a log of all calls and will be making an official complaint.) Anyway, their 12+2 for the CCA is nearly up - so we'll see what happens, Bring it on I say - I'm not scared any more so am almost looking forward to their next move!!:cool:

    Sorry for the long post but it actually feels quite good to put it all down in black & white - it's great therapy!
