    I have only used the CCA request for Halifax credit card, it was a stab in the dark because they never stopped charging interest whilst on the DMP and were charging reduced interest on the account plus OH had hassle from Moorcroft and I wanted to see what info they had cause Moorcroft were threatening all sorts.

    OH had back a signed applcation to upgrade his card account and printed terms and conditions, these could have been anybodys as they had no signature on, so had just come off the printer the day before like :rolleyes:

    I feel better now that I know Halifax have not got the right info on OH so Moorcroft have not got the info either plus Halifax sent a letter to us saying all interest will be stopped, makes you wonder why eh? ;)

    I have used the £10 SAR (Subject Access Request) to provide full details of accounts for ppi reclaims. I think the SAR should provide the signed agreement but the CCA request is obviously cheaper and puts peoples mind at rest to actually see what the creditors have on you.

    This is useful especially when you have been threatened court action.

    Oh by the way the only creditors to have come up with proper signed agreements that would stand up in court for a ccj are our loans with Halifax and Lloyds.

    Monument sent a Rapid Reply card, Barclays had sod all and come to think of it my Littlewoods SAR didn't come up with an agreement either. ;)

    Thanks fot that, I am hoping by going down this route to try to force the ones still charging interest to stop, and to be forearmed if anyone decided to go down the court route.
    Our joint loan are being particularly nasty at the mo, charging us default fees and other charges left right and centre, so if at the least I could get them to stop that would be a result.
    Now if only we could do something similar with the overdraft, the dreaded RBS:eek: then we'd be laughing all the way to the bank:rotfl: :rotfl: :rotfl:

    RBS, two with them, one under the RBS brand and one Mint, and Intelligent Finance(Halifax)
    Plus HFC bank have called today when I was out, so somethings rattled their cage because they originally accepted the DMP almost staright away.

    Both of our loans are charging interest for not meeting the agreed loan payment, I think Lloyds charging me £40 odd quid but at the moment I can't really do much about them as they have signed agreements and I don't really want ccj problems but I have complained to the FOS about them for my ppi so fingers crossed for that one.

    I think most of our creditors have stopped interest I can't say for sure because we don't seem to get statements like we used to so I can't check BUT it makes you wonder why some haven't hassled so much when you start digging.....hmmm :rolleyes: I know Overdrafts are completely different and not covered by a CCA so its a case of grin and bear it, claim back fees or try and get it paid asap

    not much help I know being on a DMP but I think its the only way out for us with some creditors :confused:

    Hey Jen! Ok tonight apart from my printer running out of ink :mad: looks like I'll be doing a sneaky one tomorrow at work printing my letters :D

    You should have seen me trying to copy four lots of paperwork to send on to the Financial Ombudsman, I was like a kid! proper messing myself (not literally of course! :p ) in case someone caught me but managed to do it all without being caught. :D

    I have a bit of a bee in my bonnet about not getting statements any more, I for one would like to see the status of the account on a regular basis as regards interest and current balance etc, without having to check my credit report all the time.
    I suspect mine are probably way off what I expect them to be and not in a good way:eek:

    Why DON'T creditors send statements when people are on a DMP, after all we're still making regular payments.

    Is it because this way they can hide their bahaviour re interest etc and we'd be none the wiser...........?

  • I personally think there are that many people involved once you default on your account that no one actually knows what the other is doing.

    Take for instance Halifax credit card, from what I can recall;

    sent letter to say struggling to pay and sent token payment, please stop interest
    ignored letter and just sent normal statement
    set up CCCS and sent another letter asking to stop interest sent token payment
    statement received with missed fees and late fees and full interest
    received letter from halifax; please call immediately
    start paying dmp payments, write again to stop interest
    contacted by Moorcroft threatening court action if we don't pay up
    Moorcroft send letter to OH mums house too
    still pay dmp and write again to halifax
    statements come through with interest and charges
    halifax send letters to contact immediately
    Moorcroft threaten SAS, FBI, CIS, DFS and SCS :p :rotfl:
    halifax ignore every letter you send
    Moorcroft threaten SAS, FBI, CIS, DFS, SCS and doorstop collector!!! :D
    send CCA and SAR requests to anyone still left in the office who can read and might know whats going on so we know who it is we have to pay :confused: :rolleyes:


    and it goes on and on, no wonder I sit on here most nights I'm pulling my hair out so confused :rotfl: who what when? :confused:

    I totally sympathise, absolutely.
    I recently wrote to RBS(bank not CC) to request they stop interest, AGAIN, and they responded (for once) as if I'd just contacted cccs about my position asking me to authorise cccs to discuss my account with them and wanting me to send a detailed financial summary:rolleyes:
    Duh! I've only been on a DMP since October, but the penny doesn't seem to have dropped with these jokers.
    It's like you say the left hand doesn't know what the right hand is doing.
    They are seriously trying my patience at the moment.:mad:
