    Its still so lovely on this board, Ive made it my home page!!!

    Can i ask, how long should I give creditors to resond to the CCA letter? and if they cant or dont respond what should i do then??

    Hiya,

    They have 12 working days plus another 2 for postage to respond to a CCA request. To be honest very few reply in this time & after this period the account actually enters dispute status. At this point you can stop paying anything (although I maintained payments anyway as you don't want to give them any further ammo against you), the next step is to give them a further 30 days. If they don't respond after this then I would stop payments until they either produce the document or agree to whatever repayment plan you want, make sure you get that in writing.

    Had 2 cheques from Halifax today for ppi refund :T obviously they haven't bothered closing OH bank account so...:confused: still have 11 creditors :rolleyes:

    MONUMENT argh!!!! :mad: :mad: :mad:

    offered refund of ppi, I wrote to them to accept offer. OH had 2 letters today at MUM's HOUSE :confused: :mad: from Lowell's to say we own the debt now for the FULL amount, no refund no nothing!! The other letter from Monument saying contact Lowells now they have been assigned the debt.

    However on closer inspection the letters look like they are from the same company. Lowells have a barcode across the top of the address and both letters are typed in the same font; Monuments standard letters are very different to the one claiming to be from Monument.

    To say I am fluffed off is an under statement :mad: :mad: :mad: , how the hell can these people write to OH mum's house when I have written every letter with our address on? How can Monument sell the debt on when they haven't refunded ppi?

    Why do creditors have to do confusing annoying things like this just to pee us all off even more? like we don't already feel like !!!!! for being in the situation in the first place. :mad:

    Sorry had to rant :p but I feel like I have tried to be 'civil' (is that the right description?) with all the creditors, we have acknowledged our debt and done it the right way but sometimes just sometimes you just think 'what is the point?' sod them all :mad:

    By the way contacted the Financial Ombudsman in respect of ppi reclaims for MBNA, Capital One, Lloyds TSB and Barclaycard. I couldn't be bothered to keep waiting for them ignoring letter after letter.

    oh well hope all of you having better luck than me this week? ;)

    Thanks Toffee, it should hopefully make things easier for us in a while. You sound like you're having a nightmare with Monument, it's so frustrating sometimes it makes you want to scream.:mad: Hope you manage to get it sorted.
    OH had a postcard with a lovely picture of flowers on the front yesterday(honestly), and on the back it said "I confirm I will be calling you week commencing 9.3.09, if inconvenient please call such a number".
    In very very tiny print it's got the MBNA adress printed on it:rolleyes:
    They are so sneaky and underhand its actually laughable, they are just trying to scare us into phoning them, by making out they are going to call at the house.
    I know very well that if we were to phone them they will say that by "call" they meant they were going to phone us!
    Yesterday I finally got around to claiming bank charges back under hardship rules, not holding my breath, this is RBS we're talking about, but we live in hope, and at least the claim is in for when the court case ends, if they are proved to be unfair.
    Next step is to request CCA's, I'm on a roll at the minute:rotfl:

    I have two creditors that match you ;)

    RBS - Mint loan and credit card - refused to reply to any of my letters. Only got one phone call from them to say I'd missed payment (when I sent a token). Told them why and they were fine and never heard from them again until 4 months into the DMP when they issued a default notice and stopped all interest completely ;)

    So interest mounted up for a few months before all went quiet - and all has been quiet ever since (I'm nearing 2nd anniversary of DMP).

    GE were hopeless. Refused the DMP, then accepted the offer from cccs, then refused it and claimed they hadn't heard from cccs. Their departments don't talk to each other!!! But they did accept after a couple of months and stopped all interest. All has been quiet since ;)

    Spoke to Helga at Payplan again today, decided on IVA, she said their IVA person will contact me in the next couple of days, hopefully start it in next few weeks, car broke down last night - head gasket gone -anything up to £400, when you're down you're certainly down, ah well things can only get better!!!!

    Please be sure you're doing the right thing, they keep trying to sell those to me, so be sure it's the right thing for you.

    alfieg40 - If you do go back to paying regular payments (and so off the DMP), be aware that if you do ask them to remove the defaults, then I presume they will also start charging the interest that kinda got us all in this mess? And so will take longer to pay the debt off?

    My DMP is due to start on 1st April and I sent token payments of £1 to each of my creditors on 3rd March, stating that this was my payment for the month etc - even though some payments not due til later in month. Anyway, will it matter that I hadn't waited for the CC statement before sending the token payment? e.g I have just had a CC statement from MBNA for March, showing my £1 payement on 5th March, but obviously still saying that I need to make min payment by 2nd April, so do I need to make another token payment for the same month, just so it shows on my next statement? :confused: Getting V Confused:confused::confused: ...........I'm thinking too much again

    Hello again MD,

    I'm always pleased to help out with any advice I can, lord knows how much I've needed over the months from different people.

    With regards the payments try not to worry too much about creditors statements, just make sure that each creditor at least gets a token payment in each calendar month until your DMP is up & running. As long as you can show you're making a payment monthly (regardless of how little) it will go in your favour.
