Alliance and Leicester own MBNA the co-op is ok to use. I was told this as I originally opened A&L but changed to co-op as major debts with MBNA

Hi you lot!
Had 2 cheques from Halifax today for ppi refund :T obviously they haven't bothered closing OH bank account so...still have 11 creditors
MONUMENT argh!!!!
offered refund of ppi, I wrote to them to accept offer. OH had 2 letters today at MUM's HOUSE:mad: from Lowell's to say we own the debt now for the FULL amount, no refund no nothing!! The other letter from Monument saying contact Lowells now they have been assigned the debt.
However on closer inspection the letters look like they are from the same company. Lowells have a barcode across the top of the address and both letters are typed in the same font; Monuments standard letters are very different to the one claiming to be from Monument.
To say I am fluffed off is an under statement    , how the hell can these people write to OH mum's house when I have written every letter with our address on? How can Monument sell the debt on when they haven't refunded ppi?
Why do creditors have to do confusing annoying things like this just to pee us all off even more? like we don't already feel like !!!!! for being in the situation in the first place.
Sorry had to rantbut I feel like I have tried to be 'civil' (is that the right description?) with all the creditors, we have acknowledged our debt and done it the right way but sometimes just sometimes you just think 'what is the point?' sod them all
By the way contacted the Financial Ombudsman in respect of ppi reclaims for MBNA, Capital One, Lloyds TSB and Barclaycard. I couldn't be bothered to keep waiting for them ignoring letter after letter.
oh well hope all of you having better luck than me this week?
take care all of you :A

thank you for this info - I have had my natwest CC for about 14 years i think - is it really worth trying to get hold of the agreement? thanks
Hi msc,
It's definately worth asking for a copy of your CCA (after all it's only a £1). A large percentage of agreements prior to 2007 were not properly executed & should that prove to be the case with Natwest it will leave you in a position of power. It also shows them you're not willing to just lay down & accept whatever threats they throw at you. I know you said you believe the threat of them taking you to court is just a bluff but I wouldn't count on that being the case. I thought the same about HFC based on wrong information I was given by CCCS, it wasn't until a court claim arrived I knew I had problems.:j DMP mutual support thread member - 135:j0 -
Morning all.
Geoffmr1 -all our loans and creditors are taken out within the last couple of years, is it worth requesting CCA's on them ready for the future - just incase- or are they too new?
Thanks

Hi md,
I'm of the belief that everyone should request CCA's regardless of how new etc. It's not about debt avoidance it's purely a case of making sure the creditor did execute the agreement properly. If it turns out they didn't it doesn't mean people have to stop paying them it just means they will eventually have to agree with whatever payments you offer them until the debt is paid.
The main reason I request them is so I know exactly where I stand. If a creditor sends you a CCA which is properly executed & later instigates court action then you know from the start you can't beat them. If thats the case then should they be attempting to gain a charge over your property it's sometimes better to agree a voluntary charge on the basis that 1) All interest is stopped, 2) That the creditor won't go for an order of sale & 3) That they will agree to the DMP payments for the duration of your debt.:j DMP mutual support thread member - 135:j0 -
Thanks for that. I think it's worth a go, like you say, it's nice to know where you stand, and I'm all for covering all my options. I have seen a template letter flying around somewhere but am struggling to find it, can you point me in the right direction pls? Also, is it the same letter for cc's as loans?

thanks ad1jnl i was just coming on here to ask that question, also are we supposed to just send the cccs notice of dmp or are we meant to include the budget and the list of creditors that cccs sent, only we have 7 copies and 7 creditors so thought maybe they were meant to have themSAHM getting organised 2010.
