Hi everyone - hope you all had a good weekend, no post yesterday and none today:j ...although i was a little disappointed i was hoping to get a CCCS letter that might say if another creditor has or hasnt accepted our offer of payment.

Second lot of token payments were sent yesterday and as i posted on Saturday we are at 6 defaults so far.....

So on to my question....when you more experienced DMP'ers mention 'going to court' what does this actually mean ....do you personally go to court:eek: ....does it go in the papers  etc...i know i probably sound very naive but i havent a clue other than that in the majority of cases if you are on a DMP you are asked to just carry on paying....can anyone explain it a bit more for me please????

    thanks xxxx

    Hiya,

I've been on my DMP for 18 months now and none of my creditors have taken me to court!:D

2 of them thretened it, but it never got very far because I sent them a CCA request and they couldn't produce. Well one couldn't produce at all and the other sent an unenforceable one so have backed down!

If you know your rights and know what to reply with, if they do try to take you to court, they'll soon back down!;)

    Cocker:)
  • Hi guys, been really busy at work and not had much time to get on here last week so a big hello to all the newbies.

    Just to update...

Bank of Scotland sent me a letter on Friday charging me £30 for three attempted phone calls and £10 for the letter!!!! How can I answer the phone when I am at work? I now see that the AA loan I have is also part of Bank of Scotland so will wait for another letter!

Then today I received a letter from a debt collecting company informing me that they have taken over the debt. I rang them to find out where I make payment and informed them about CCCS, DMP etc as Bank of Scotland had not even responded to my notification letter of my DMP or to my token payment last month. Do you think I should write and complain about the charges?

Barclaycard and Halifax have not responded and are sending statements for my credit cards as normal!

HSBC (my lowest debt) have refused the £5 reduced payment and want £9 even though the payment was only £10 originally.

MBNA and Virgin (one of the same) have both accepted the reduced payment offered. :T

Just waiting to hear from Lloyds (two loans) and my current account is closing with them on Friday so will wait and see!

Well that was my Monday, hope you are all good.

I have debts at £52,000 and should hopefully be paying just over £1000 a month into my DMP so I am hoping my creditors will accept quickly and without too much fuss.

I've also had a letter from RMA regarding a monthly payment from Feb for my A&L credit card.
Should I write to them separately explaining that I am in the process of starting up the DMP or will my letter with token payment to A&L cover them as well?

Think my question got caught up amongst my rambling on:o so am reposting it again as the thread is moving quite quickly tonight.

Hey folks, i finally managed to get everything together and sent off to CCCS, im really scared though!!! i could pee my pants!!!!.
Im glad to be getting on top of things but scared of the unknown.
I sent all my token payments of 1 quid today, was so embarrassing asking the woman for 12 1 pound postal orders haha!!!

Do you think they would let me start my DMP in may?? For no other reason than i want to stockpile some cash really!!! never ever had any savings!!!

My main problem at the mo is i am in the process of changing my account from lloyds tsb to abbey, abbey have sent me a new card but no pin as of yet, i don't want to put my money in it until i can access it!!! need to jump ship on llloyds as soon as possible as have just defaulted my loan with them !!!! how long before they catch up with me and nick my funds mwahahahahaah!!!! (im scared really)
proud to be facing debts of 16000k
will be debt free in 3 years 9 months:beer:

It's great to hear everybody's different experiences and advice on here... I think this thread is FAB! :j

It's such a relief to be able to talk openly albeit anonymously about my debt and DMP. Have actually told one friend about it (DMP and MSE) but I don't really think she 'got it' if you know what I mean.:D

    RMA? Risk Management Alternatives?

They are just a DCA who has been contacted by one of your creditors, I would just inform the main creditors about the setting up of your DMP Jen for now.
