Candygirl - I chose to pick up the phone and explained my position, they didn't like it but there you go. Just be consistent and don't give them any money you don't have! Eventually they will stop when they get the message. One thing I did find is that they kept saying they hadn't received the Letter of Authority and Financial Statement from PayPlan, so I had to go back to them several times to resend the information. Again, it's all quietened down eventually, and I have a few defaults, and a few temporary payment plans. The most difficult have been the smaller OD debts, and another small debt from when I purchased a sofa(!).

MBNA - I had these through Abbey. Awkward to start, and quite rude (though one person I spoke to understood my position totally).
Halifax - Defaulted after a few months. Phoned a lot at the start.
Sainsbury's - Ditto. Phoned a lot at the start!

Not sure if i'm anyone will reply, but am getting so many phone calls and letters, even though i've written to creditors with CCCS number and have paid token payments for 2 months:rolleyes: All I can do now is ignore the phone as i've spoken to them all so much:o
Have you put it in writing to your creditors that you are formally notifying them they are not to contact you by telephone but must correspond only in writing? I understand if you do that, and they still telephone you, they are breaching some harrassment law/official guidelines, and you can then report them (but you tell them first, in writing, that you will do this if they continue to telephone you as what they are doing then constitutes Harrassment of a Debtor).
I think on the "ask a CCCS counsellor" thread one of the CCCS reps has posted a sample letter to use to request they no longer contact you by telephone, if that helps. If you do choose to answer the telephone to any of your creditors, simply refuse to answer any security questions they ask (meaning they cannot discuss your account with you over the telephone), tell them that they are to contact your representatives the CCCS, give them your CCCS number, and firmly state you will NOT discuss your account with any representative of their company by telephone. If they carry on yakking after that, repeat you will not discuss your account over the 'phone and advise them you are now hanging up. And do so! You could also, once having told them you will not discuss your account over the 'phone, tell them you are now starting a recording of the telephone conversation, since you have told them you will not discuss the account with them and that you now want official proof to use in any potential future case against their company for harrassment. Whether you DO record or not is up to you - but it should shut them up

Can anyone help me to find a letter template please?
One of my creditors is still charging me extortionate interest while on my DMP. CCCS have advised me to write to them again reminding them about the banking code sections 14 or 15.
has anyone written a similar letter quoting the banking code which I can use as a template? It would be really useful

Have you tried the Letter Templates section of the Consumer Action Group forums? http://www.consumeractiongroup.co.uk/forum/letter-templates/ I think you have to sign up for the site to view the templates, but that's no bad thing, it's an excellent source of information on all things to do with debt, as well as many other things!

Hi all
thanks toffeepenny for your post advising on dmp's.
I guess im just worried as prior to this ive always paid on time and had a good credit report and now the thought of all that going down the drain really upsets me. I know its my own fault for running up the debt but i really never thought that my life would turn out like this, sorry to be so miserable. What im most worried about is creditors ringing me at work (do they often do this?) as i work in admin and finance so wouldnt want people to know of my situation. im thinking if they do phone me at work, i will just say "im sorry im not allowed to take personal calls at work, please could you either write to me or phone me on my mobile", do you think that will be ok?
Only have 4 creditors so at least thats one thing, and think i am offering a fairly good amount to start with on the dmp and hopefully will be able to increase it, oh im feeling more positive now :-)
I guess what gets to me is knowing how much easier my life would be now if i didnt have the debts (see my diary for full explanation) and just wishing i could turn the clock back and change things, but i guess we all wish that.
Is there any advice about my situation with the loan, overdraft and bank? detailed a few posts earlier...

Hey all, thanks for good wishes regarding interview.
Mot sure how it went, was a bit quick, not a good sign I think, oh well, will keep on trying, at least I still have a job in the meantime. I work in retail and theres loads of people chasing the same jobs I suppose.

Suzie, not too sure about your situation with the bank, I would be inclined to go along with what cccs have said, sometimes you can end up worrying yourself sick, wondering whats the best way to go about stuff.
One of my creditors who I have two cards with wrote ages ago to say they were stopping the interest and then just kept charging me anyway, so even when they say they are going to do something they end up doing the oppposite!
