    I've received some court papers in the post today from Incasso on behalf of RBS - they are our biggest creditor. They sent a letter dated 09.02.09 and saying they would issue within 7 days if they didn't recieve the amount outstanding (like I've got £31k stashed down the back of the sofa!). Anyway the papers have arrived so I rang them and they said Payplan had contacted them but they weren't prepared to accept the amount offered - their client wants £523 pm, which is about £200 more than what we were paying before the DMP, and if that couldn't be paid they were looking at getting a Charging Order. I always knew at the back of my mind that this was a possibility but now I'm really scared.

    I've spoken to Payplan who've told me what bits to fill in and then to send the forms to them to complete the rest and they will then send it back to Incasso.

    We've been on the DMP about 7 months and everything seemed to be going ok and I was feeling really positive about it all - facing up to the mess we were in and dealing with it - but now I just feel like I've hit rock bottom. DH is at work so not told him yet and have managed to get the kids out the way to give me a bit of peace and so they don't see the state I'm in.

    If anyone out there can give me some reassurance I would be so grateful.

    Yummy - I can totally sympathise and know how you are feeling - had our court papers a couple of days ago for our £20,000 Northern Rock loan - knew it would come to this but a horrible feeling when it does. However, I now feel much more positive about it. The CCCS were great - talked me through everything and have strongly advised me to go down the Debt Arrangement Scheme (DAS) route which is monitored by the Scottish Government. Gives more security to home owners and once accepted interest has to be frozen. Went to see the money adviser today and the ball has started rolling so I am hoping and praying it all gets accepted - anyone else on here have experience of DAS?
    No more credit for me - I will no longer live beyond my means :A

  • Hi all i posted a few days ago asking about whether cccs would let us wait til may to start dmp as we have mot with a definite fail coming up! got an email today saying just dont send paperwork til april and it will start in may!

    so am quite pleased with that.
    Now just have to get token payments and letters sorted, am thinking as our creditors are all hsbc or egg that a cheque should be ok as they are such big companies surely they wont forge my signature on anythng else! a

    also saw a template for letter to send about token payment but have lost it again, anyone any ideas?

    Egg have written to me today to say if i do not agree acceptable payments with them in 48 hours they will issue a statutory default notice - am i right in thinking that i want them to do this sooner rather than later anyway???? thnks

  • Penny 39 if you have completed the debt remedy online with CCCS - then they will send the paperwork out to you - so you have already been accepted - I never received a phone call or anything as the DMP was approved online it went very smoothly - the only contact I have had with CCCS was to ask them to increase my shopping budget.

    With regards to token payments - yep send them out with covering letter
    something along the lines of this will do:-

    Reference :- {insert CC or loan agreement number here}

    Dear Sir / Madam,


    I am writing to inform you that I am seeking advice and assistance regarding my current financial difficulties.
    I have sought the advice of “CCCS” and I am in the process of trying to work out a Debt Management Plan with them.

    In view of my circumstances, please accept the enclosed payment of £XX in lieu of this month’s payment to yourself. To this end, I would appreciate if you would freeze all interest and other charges on the above account so my debt does not increase.

    Thank you for you assistance and understanding in this matter. I would appreciate it in future if all correspondence be made in writing to me.

    I look forward to hearing from you as soon as possible.

    Yep this is in fact a good thing, they are more likley to accept reduced payments via the dmp once default is in place. And once you have cleared the debt they have to remove the default from your credit file.

    Q-Does CCCS or Payplan send their pack information by special delivery?
    As I got a Royal mail notification sorry you were out... advising that they have a letter that requires a signature.I am not expecting anything?
    Or will one of my creditors send me court papers this way?:eek:

    Iv just logged into payplans justabank site, and i am well impressed, all my creditors listed ballances, amount of repayments they are to be getting, loads and loads of great information...i never got this with the flipping fee paying company!!!

    I can see i am going to be logging in lots just to see all the ballances go down, i have it all on paper but to see it online thats cool!!!

    Sorry sad Donna moment lol..im sooooooooo easy to please!!

    I didnt have to sign anything with payplan letters, not sure about cccs though.

    Egg did this to us as soon as they recieved notice of the DMP. Nice lady called me and, after a brief conversation said "ok my love, Ill just get a Default issued, and well deal with PayPlan".
    Result, no phonecalls from Egg for over 2 months now, except for the odd one chasing the direct debit for our Egg Card which we have to make 3 statutory minimum payments before we can move that onto the DMP too. Then were hoping they just issue a default and ... Job Done.!
