Good Morning Lovely Peeps!
Thanks again for your advice yesterday, i feel like a weight has been lifted. Thanks as always.:D0 -
Good morning everyone! Not made it here for a few days and I feel SO much better now I have!
HOPE TRMD- I read your post re bank a/c and was sooo pleased and then the "need to open another one";GOOD LUCK, have everything crossed for you. Still waiting for mine and watching the clock today waiting for the postman...
Massivedebts-I hope you have a better day today, you have been an inspiration with your posts. x
Buzzybee-another single mum of one-are we a trio with HOPE?! It's great that there are so many of us at roughly the same point and that we have so many "oldies"to help us.
DLB-your day sounds similar to mine yesterday. Went to a local reservoir/play area, took a picnic and our popup tent with loads of rugs,we had a fab time. And am now a true money saver-£2 to park, thought "blow that" so drove half a mile down the road beyond the double yellows;sad or what?!
MNM-thankyou for more advice re letters, couldn't have done it without you,off to post shortly.
And nearly forgot Hope TRMD-"chicken challenge"! As I said, only 2 of us too but roast chicken dinner day 1. Completely strip chicken and make stock, use for soup and also large pan chicken casserole which does us for a couple of days. Also use stock for a risotto, usually mushroom. Chicken and veg pie also goes down well and sandwiches. CLUCK CLUCK I hear you say! Have a fantastic book which was a present last Christmas and it completely inspired me to use every bit of food available-possibly a sign of advancing years but it works for me!! Good luck x
And a BIG THANKYOU to you all, this thread is full of wonderful people, will be here for almost 10 years too x
EEk! Just had paperwork from CO-Op bank pop through letterbox-hurray!-but paperwork includes authorisation from current bank for list of DDs so that they can transfer smoothly-will my bank say something as they will obviously realise something is up when they see am changing a/cs? My biggest single debt is with them and am overdrawn too. Also, application approved in principle, aargh, could it go wrong? Have not yet registered with CCCS,just filled in details online, got remedy and saved with my number ready to sign up when set up bank a/c. Should I just be signing up before bank finalised? Sorry for all the questions, bit befuddled!!!DMP Mutual Support Thread member no.2490 -

Hi all
I've received some court papers in the post today from Incasso on behalf of RBS - they are our biggest creditor. They sent a letter dated 09.02.09 and saying they would issue within 7 days if they didn't recieve the amount outstanding (like I've got £31k stashed down the back of the sofa!). Anyway the papers have arrived so I rang them and they said Payplan had contacted them but they weren't prepared to accept the amount offered - their client wants £523 pm, which is about £200 more than what we were paying before the DMP, and if that couldn't be paid they were looking at getting a Charging Order. I always knew at the back of my mind that this was a possibility but now I'm really scared.
I've spoken to Payplan who've told me what bits to fill in and then to send the forms to them to complete the rest and they will then send it back to Incasso.
We've been on the DMP about 7 months and everything seemed to be going ok and I was feeling really positive about it all - facing up to the mess we were in and dealing with it - but now I just feel like I've hit rock bottom. DH is at work so not told him yet and have managed to get the kids out the way to give me a bit of peace and so they don't see the state I'm in.
If anyone out there can give me some reassurance I would be so grateful.

yummy mummy post this on the main dfw board as there are losds of really good people there who can help - my heart goes out to you as ive had court paper in the last week or so - BUT dont panic im sure someone will help!!0 -
Yummy, I found this on CCCS website for you xxx
Don't panic lovey, it really does sound worse that what it is
What should I do if I receive a County Court Claim form?
This information relates to the procedure in England and Wales. If you receive a County Court Claim Form you do not need to attend Court but you do need to reply to all correspondence within the specified timescales to ensure the Court takes your situation and views into consideration.
The Claim Form will arrive by post, together with 'Admission' and 'Defence' forms. You should complete and return one of these forms within 14 days.
IF YOU AGREE THAT YOU OWE THE MONEY (known as 'Admitting the claim'):
Complete the 'Admission' form with details of your offer of payment. The amount you offer should be the same as if Court action was not being taken.
Do not feel pressured into offering to pay more than you can afford.
Return the completed Admission form to the address on the 'Acknowledgement of Service' which accompanied it (not to the Court). If your offer is accepted, the creditor will ask the Court to make a Judgment and the Court will inform you. You will then receive a form marked 'acceptance of offer' showing how much you have to pay and when you have to pay it. If the total owed is less than £5000 then interest will normally have been stopped.
When can a creditor take me to Court?
If you are behind with the payments you agreed when you first took out a credit agreement, even if you are making reduced payments, your creditor can take you to Court by issuing a County Court Claim form. The cost of any resulting Court action will be added to the amount you already owe.
The creditor must formally let you know you are in default by issuing a Default Notice, before commencing Court proceedings. What should I do if I can't afford to pay the amount set by the Court?
If you can only afford to pay part of the amount ordered by the Court; you can make an 'Application to Vary an Order' using Form N245 which can be obtained from any County Court. Complete form N245 and send it to the Court. There is a fee of £30 which can be waived in cases of hardship.
If you cannot afford to make any payment to the creditor; you can make an 'Application Notice' to have the judgment set aside using form N244 which can be obtained from any County Court. Send the completed form to the Court together with your budget. There is a fee of £60, which can be waived in cases of hardship. The proceedings may be transferred to your local Court and a hearing date will be set.
You must attend the hearing.
What happens if I fail to make payments under a CCJ?
If you do not make payments under a CCJ, the creditor can apply for:- An Attachment Of Earnings Order - so that a sum can be deducted from your pay before you receive it
- A Charging Order - so that the debt can be secured against your home/property
- A Warrant of Execution, enabling County Court Bailiffs to visit your home

Yummy Mummy, am a newbie and can't help but am sure there will be people along later who can. I know it's awful when children are around and you keep trying to smile but you feel like you are dying inside. Much as we love them sometimes I know there are times that I just need to be able to give in and have a good cry-not possible!. It may be that when they see that you really can't pay any more they will accept. I am keeping everything crossed for you xxDMP Mutual Support Thread member no.2490

Saw a comment from DLB a few pages back-said to someone else that she had been to court and ended up paying less than previously was on DMP. As Toffeepenny says, try not to worry-things are never as bad as we imagine they may be and we will all have wobbles as we go down this road . Take care xDMP Mutual Support Thread member no.2490

Exactly Penny, but it is up to the Courts to decide and honestly do you really think Judges have time for this? (not meant to sound harsh) Greedy creditors who are pushing to get more and more out of people, no wonder why so many are choosing the bankruptcy option and telling them all to stuff it or like some poor soul on here who was thinking about suicide!
I can't see how any Court will side with the creditor UNLESS you have been taking the mick and have masses of savings somewhere or haven't wanted to pay but if Yummy has been paying for 7 months through a DMP then that in itself shows willing.
The Court will more than likely stamp the papers and agree to the same amount as paid through PayPlan.DMP support thread member 211 :cool:I'm only here to get some medals......honest!0
