As I got a Royal mail notification sorry you were out... advising that they have a letter that requires a signature.I am not expecting anything?
Or will one of my creditors send me court papers this way?

Thanks for that Cocker..i would never pay anyone to do anything again!! lol..did the bank charges myself price of 2 stamps got me over £1300 back!!!
And helped my friend take Barcleys all the way to court stage of reclaim, just not seen a step by step of what to ask for ect on this.

I see you say you have only done this will creditors that have not accepted your dmp, i claimed bank and credit card charges back whilst in dmp agrement with them..so just wondering why not try it for the others.

I am most interest in how to go about this if it can be done yourself like the bank charges.

I'm just about to start reclaiming bank/credit card charges. That is my next mission!;)

The whole "bank charges on hold thing" has kind of put me off so far, but I will get to it soon. Going to try and use the hardship rules for the bank charges. If successful, it would wipe out half of the overdraft debt with LLoyds in DMP. Also, you cant do a CCA request for a cuurent account, so this is my only option for reducing the debt on that before offering a full and final somwhere down the line.

Got ppi reclaims in hand though. One is with the FOS and other is still waiting a decision from lender. Both of these are not connected to DMP debt so fingers crossed!

Also got two more ppi issues from debt in the DMP. Strangely enough, these are both from the two accounts that are causing the most chew! Both sent CCA requests, and both creditors now in default of CCA request as they haven't provided the required documentation in time, so as things stand, both are unenforceable at the moment.

Have a look at stapeleys thread entitled "CCA request updates please" for some great information and advice on all of this. Also, there are template letters on the National Debt Helpline website and also on the Consumer Action Group website. (They really know there stuff on there) I've spent literally hours searching through similar situations as mine on there. I just get drawn in and before you know it, it is 2am and I need to be up for work in the morning!!!:rotfl: :rotfl: :rotfl:I'm sure other half thinks i'm chatting to random woman in chat rooms all night!!!:rotfl: :rotfl: :rotfl:

    Cocker:)

  • HOPE,I hate it when I get a Royal mail card and not expecting anything, sends me into a spin and usually turns out to be something unrelated-all that worry for nothing! Ditto "private number" on calls,o8 numbers etc. I hate wishing my life away-and I won't!-but can't wait to be finally sorted on dmp. Hope all ok-maybe a long lost relative left you squillions!!x

  • I know how you feel Cocker :D , I feel I have not had a proper nights sleep since December since I decided to start my reclaiming ppi and card charges. But you have to remember the research pays off and you do become wiser because you now know what the creditor can and can't do. I now have MSE, CAG, FLA and Financial Ombudsman in my favourites! :o

I had a letter today from OH Halifax credit card, they agreed to put him in a position if he never had ppi due to being self employed. :T  :j

We are hopeful now that we will have success with all our ppi claims, so far we have had success with Monument who are difficult to claim from, not many success stories out there so feel lucky with that one.

Halifax 3 loans and credit card have just agreed to pay back, will receive payment within the next month. As much as I would love the cash in my back pocket I know it has to go towards the debt but this is a good thing so smiles all round in my house! :D

I sent off a CCA request to Halifax card as they were just annoying me that they recently started charging reduced interest on OH account. I'm sure he signed up in 2001 so fingers crossed they can't find it! :D Makes you wonder why they so quick to pay out on the ppi eh? :D

I have also claimed back Halifax card fees, Monument card fees and Great Universal charges.

Lloyds seem to be putting up a fight with their FINAL RESPONSE letters  How can a company respond to a customers claim like that from their first letter?. It seems most creditors are encouraging to go through the Financial Ombudsman which takes months and months to even get looked at through the sheer volume of people using the service due to sites like this. It's fobbing you off and to be not recognising a customers complaint and dealing with the issues raised is damn right rude and not good company policy.

Thing to remember is not to fall at the first hurdle you will receive letters back saying their charges are fair, you ticked the box for ppi, this is our FINAL RESPONSE sod off!! but you have to keep at them all the way.

Sometimes fighting back is the only way to keep sane amongst the DMP madness.

    Thanks trmd.
I think the card you are talking about is a jb card..its like a pre loaded credit card that payplan can issue you with if you want it, no credit checks...you pre load money on the card then can use it as you would a credit card for online purchases ect only differece being you have already paid in advance.
All details are on the justabank site which if payplan have sent you your password you can get on and see how dmp set up is going and loads of other stuff too.

Hi all, just been trying to catch up with everything as not been on here for a week, things have been moving too fast, it's taken me about an hour to catch up:rolleyes:

OH had letter from MBNA yesterday of the "pay us xxxx now or else" variety, he's so far made two token £1 payments to them while we try to sort out the budget so he can negotiate reduced payments with them. Interestingly they also said there was a possibilty that he could negotiate with them to get a "significant" portion of the debt wiped off which surprised us, did'nt think they would offer that after only two missed payments.

Unfortunately we haven't got the necessary cash stashed under the bed:rotfl: otherwise would love to take them up on it.

Hope those recieving court papers manage to sort things out without too much added stress, that would scare me half to death I think.
