  • I totally agree with what you said here, truth when it dawns on you that you are deeply in the brown stuff it really is scary and I would not have the courage to miss payments back then I was too scared and worried. Now I couldn't care, well I do I take that back, but I don't worry as much as I did because I have found out what creditors can and can't do.

    But I would have liked to have missed a few payments to go to Gran Canaria before my DMP though:rotfl:


    I agree with 2spicy's comments too. Love the bit about Gran Canaria Toffee Penny in hindsight I think we all would have loved to missed a few payments and had a break but to be honest I am glad I just got my DMP sorted and managed to get a couple of months money behind me. :j

  • Thankyou MNM for the advice and the letter,will use and post off asap-had a text from Cap One today asking me to call but think I am ok to get a letter off to them saying I wish to communicate in writing and not call them-is that right?

    Hope TRMD-I know exactly what you mean re bank account-I feel like a "bad person" and have to keep reminding myself that I am not, just a poverty stricken one!! Am watching the post and keeping fingers crossed-any news on your account yet? I just can't wait to get started properly-this will be a tough month as my £400 plus bank loan will still go and one cc payment by dd which didn't stop in time,car tax and MOT due so will be diddly squat to eat with.. good job set myself the goal of not throwing ANY food away a few months ago. Mushy bananas =banana loaf,leftover bread =crumbs for homemade chicken nuggets and friends laughed at my "chicken challenge" when I told them one chicken does 5 meals in our house-only myself and little girl though,goodness knows how I'd cope with any more! Think I had the last laugh though as it now catching on in the rest of the department..x

  • Hi Penny39, yes, that's right, you are quite within your rights to request that all communication is made in writing and not by phone.

    I was on my way off to bed so havent had chance to read back through any of your other posts - have you already changed your bank account? Is there any reason why you cannot stop the DDs coming out of your account by just cancelling them (I've done that before online with my bank account). I think you need to have two clear days for the instruction to be acknowledged. If you can stop that loan payment coming out for this month then that would help with being able to sort your car out? I know in some cases if the loan is with the same company as your bank account that you wont be able to stop the payment (eg HSBC bank/HSBC loan).

    My hubby was naughty in the past, he just drew all remaining money out of the account and when the loan payment was "requested" it just took him overdrawn - not much the bank could do because the next month his money went into his new account. The outstanding debt was just added into the plan, so he's still paying it, just in a roundabout way!!! It's sometimes a case of who needs the money more ... you or the bank? Not sure if that's very helpful to you :confused:

    Good news …got a cheque book and PIN number in the post!!!. :j
    I received no welcome account opening letter stuff……not that bothered about all the niceties! Sort code and account number does it for me…:D
    Now I can advise work tomorrow so hopefully they can activate the change before next pay day. Then I can start to amend DD for other essential bills.
    And wait for CCCS pack to come through which I applied for. Payplan call is 2 days away.

    Barclaycard calls are a pain; they have maxed out my house answer machine.
    But now they are calling me at work. OMG what will people think when I keep getting so many messages from Barclaycard at work!!!! I can not afford for this to come out.

    Deep breathe….ACTION not panic….
    I am sending them the token payment & the fab letter MNM posted tomorrow!!!
    Will they stop then…or do they continue?

    Hiya, if they continue with the phone calls it will be classed as harrassment and there are more strongly worded letters around the site somewhere that will help take your complaint further - its just a question of finding them ;) I will try and look for them to help you along. I can feel myself cringing - they did that to me too and you just want the ground to swallow you up. If the call actually got through to me I just used to tell them that I'm at work and cant speak to them. It throws you though because you feel like there is nowhere to hide!

    They will stop eventually though, took about 2 months and now I dont hear a peep out of them!

    Great news on your bank account - I still miss my cheque book :o (it came in useful with ordering school uniforms etc). Never mind, I havent died because I havent got one - I just have to find new ways to pay!

    I too am aiming to sleep ... have been aiming for it since 10.30pm ... but I'm still here!

    I really must log off now and go to bed! Sweet dreams everyone.

    You’ve got it ...it's exactly how I felt. :eek: Before I went to the CAB, they called me at work and I did explain to them that I was going to meet the CAB and would be in touch. The lady did not want to get off the phone, she kept saying can I give her my debit card details so that she can take payment NOW...she was asking for diff ££ amounts. I realized she was infact on auto pilot and that she was not listening to me. I said I cannot talk further as I was at work and had to put the phone down.
    After reading the threads I now know that I should not speak to them or at least use the one liner re I'm at work and cannot call and drop the call.

    I'll hold onto the fact that it will stop soon.
    Good to know that there is a letter that I can send out should it not.

    Oh dear I'm not really here...I'm going to bed NOW!!!! REALLY!!

    Morning all.

    Well I bookED MOT for the middle of March..i hope it passes i hate MOT month!!! LOL
    I survived shopping ok kids were really good and stuck to my budget!

    Cheque book i did miss at first, but not anymore..i look at it as another form of credit as it was so easy to think ill just write a cheque because by the time its cleared the wages will have gone in the bank...so i was borrowing from money i hadnt yet got which then led to shortages on payday. I have a very good friend who knows about my dmp and if i need a cheque for payments to school ect i give her the cash and she writes me a cheque. I just find cash only the only thing that will ever work for me now.

    Regarding phone calls

    1- At work ` Im sorry im at work, please dont call me until after 6pm` HANG UP

    2-At home If you are getting nowhere with the person on the end on the phone or you just dont want to speak to them say
    `I am with (payplan/cccs) this is my reference number this is their phone number, please call them as they are fully autherised to discuse the account` HANG UP

    Talk over the top of them if they continue to speak...they soon get fed up of getting the same automated response!!

    This worked for all my crediotrs..they soon gave up and delt direct with the dmp company...iv hear them all come up with excuses
    1-We are not allowed to deal with the dmp compnany-RUBBISH
    2-We need a payment today or futher action will be taken-NO WAY
    3-We have to speak with you before we will consider reduced payments-WRONG
    4-We can help you deal with this without the use of a dmp-NO WAY
    5-You credit rating will be effected- SO WHAT

    Dont they them get to you...you have taken the step of getting help in the form of dmp...so now take control..its your phone you dont have to speak to anyone you dont wish to, they will give up i promise.

    From advice that I was given you dont have to speak to anyone other than in writing so send Cap one a letter. I have Cap One as one of my creditors and to be honest they phoned once then I sent them the letter and since they have now confirmed in writing that they will freeze the interest and charges so thats a positive result ;) .

    I am afraid I dont like speaking to creditors on the phone because they do try to bully you into making more than the payment you can afford but the calls stopped after a week or two and to be honest I didnt have many I thought that my phone would be ringing at all hours but it didnt. Halifax bank have also frozen all charges and interst on overdraft too - :T - Halifax one credit card seem to be still charging but its very early days and to be honest I am surprised that nearly 60% of my creditors have already frozen charges. I guess everyones different.

  • the best advice ever? - dont talk to them over the phone insist all contact is in writing

    i used to do this then last month link financial called me at 8 in the morning (i was still in bed - lazy sod i know but it was a late night before) to say my debt with ge capital had been passed to them - this was the first id heard of it so we proceded to have a very heated debate with me say i dont know who you are etc ands them saying they want £5000 straight away blah blah blah or well take you to court etc etc well by that time id had enough and accused them of threaning me etc - in the end it was them that put the phone down - result you may think and i certainly did at the time - but its bitten me on the a**se - got a letter 21/1.9 to say they had taken over the debt and 3 weeks later court papers!!

    im very upset over it but after advise form 10past6 on here im gonna fight it (there a thread here if you want info http://forums.moneysavingexpert.com/showthread.html?t=1490071 )

    maybe my first conversation with them did not influence their action and im sure they would deny it even if it did but for me in future i will refuse to answer sucurity questions and INSIST they write to me or my dmp manager if they require any info

    please be reasasured that from what ive read on here my circumstance is unusual i just wnat to highlight the importance of insisting on written communication

    Wether you had spoken to them or not this would have happened..the phone call was to try and get you to pay up..they would have taken this action anyway.
    Just keep refering them to the dmp company you are with, they have to speak to them .
    They also have to put anything offical in writing so phone calls or not they can not do anything major without writing to inform you.
    Phone calls are there scare tactics...try and make em pay before we do the paperwork.
