Afternoon all.
I have today parked in a car park which always used to be a pay on exit car park. We parked in there today and the signs said that parking fees were £1.50 for up to 4 hours.
The signs said nothing about pay and display.
When we left the car park there was no barrier on the exit road, and assumed they were faulty so got a freebie.
We got down the road and the "parking charge notice" slid up the windscreen!
We had been ticketed for not displaying a ticket.
Now as i said about above, the signs were all in very small print (except the parking charges) and nothing was obviously stated anywhere about a pay and display. This car park has historically been a pay on exit, and we thought this was still the case. Our last visit was a few months ago and there were no signs advising of the change.
Reading through the guidance I am very keen on the idea of ignoring it, and any further correspondence. I pursued with my bank charges and got £450 from HSBC, so am keen on continuing my money saving hobby!
Two things concerns me though;
1) The car is a company car owned by a fleet company, who I am concerned may pass on my company details, who may pass on my details to Euro car parks. I know that they do not legally have to do this, but they may decide to anyway, to avoid any hassle from Euro car parks. I would then have to pay a £25 admin fee to the fleet company for this. The fleet company is part of a large, international bank so will probably "do the right thing" by passing on my employer details to Euro car parks. My employer may also decide to pass on my details to Euro car parks, as they may also want to "do the right thing".
2) The Euro car parks tickets states that my details may be passed to a third party authorised by them for the collection of unpaid parking charge fees, (i assume a bailiff company). Can they do this before court action?
What do people reckon my chances are? Do I need to be concerned about these 2 points?
The "fine" is £70 to be paid within 21 days, reduced to £50 if paid within 14 days.
As an aside, the date looks wrong, as this they have written the date on the top copy wrong, then tried to write over it. The date on the two carbon copies looks like it could be 23, 28 or 20 /10/09 and i was somewhere else on both those days. My car is fitted with a datatracker to prove this.0 -

1- make sure your fleet manager and the lease company understand the difference between a parking fine and a PPC invoice, and make it clear to them that all paperwork regarding this is to be forwarded to you so you can ignore it. [Check the wording of your lease agreement, it will mention fines and penalties but not scam invoices].
2-Euro crap parks can pass your details to a third, fourth or fifth party if they like but it won't make any difference, it is still unenforceable. A debt collector is NOT a bailiff, and has no power to do anything other than beg you for money. Bailiffs can only become involved after these three things happen:
1 - They take you to court, [more chance of winning the lottery],
2 - They win [more chance of winning the lottery two weeks running]
3 - You still don't pay up.
PPCs love company cars. Your main problem is your employer and the lease company. Get on to them first thing on Monday and make it clear that you do not authorise any payment to these parasites.0 -

To help others hear your good news you should really post this again on the thread entitled "Parking Appeals - Successes and Failures". It is more likely to be read there by people who need a bit of help themselves.
In passing, you may have missed post number 630 that I put in response to yours on Page 32 of this thread. You might like to have a read of it now. Nice to know you would not have been alone if your appeal had gone the other way.

Spoke to my fleet manager today. He is of the opinion that as the ticket is issued by a private company, on behalf of the council I should pay it. If I dont, and my company get the invoice, they will pay it and deduct from my salary plus a £25 admin fee. So £50 turns into £100!!

This is not on behalf of a council according to your description.
Does your contract allow for such deductions, even in the event of a council PCN such unauthorised deductions would be unlawful.0 -
