I parked in a private car park and obtained my ticket at a cost of £1.40.I returned to my vehicle well within my time limit.I found I had been fined because my ticket had flipped over so the operative could not read the time and date. The charge was £90.It has since gone up to £267,because it happened almost 2 years ago.I contacted the firm on the same day the incident occured stating the above facts but they said I still had to pay. There is no signage in the car park stating that even if you buy a ticket and it can't be read then you are still eligable for a fine.I have recieved a final demand with further costs to be added and court proceedings.I still have the original ticket.Anybody any ideas.Regards Kev.

When you say "court proceedings", have you actually received properly stamped court papers, or are the company just saying they may take you to court. Could you tell us the names of the various companies involved, and could I point out this is not a "fine", it's an invoice.

Do you mean a list of charges that might be added?

    Like!

    Original charge £90
    Admin charge £50
    Preparation of court papers £50
    Court costs £50
    Bus fair to work £2
    Tin of cat food £1
    Box of tea bags £1
    Pint of Milk £1
    Packet of biscuits £1.50 [Hobnobs]
Money for the portacabin meter £2
    Bus fair to home £2

Followed with something like this! These are the charges that "MAY" become payable "IF" we proceed to court, and "IF" we win.
If you do not pay any amount the court "MAY" order we "MAY" return to court and ask for a warrant for a bailiff to attend and seize goods.Or ask for an attachment of earnings order.

I wrote that out and it means about as much as the letter you have received! Its just another threat. Ignore them!

Kevin, the landowner has suffered nil damages, therefore ignore ignore & ignore some more.
  • Thanks very much for everyones input.I have only recieved notification of possible legal action. The extra charges from £90 to £267 do not show how these charges have been calculated.I will wait for my day in court and hopefully win.Once again thanks for your time.

You will have a very long wait, as there is a 99.9% chance that it will never go to court. Note the word "possible".

  • just got to add,the companies involved are national parking control and daniels silverman dept recovery agents. If the time and date cannot be read, there is a serial no front and back that I am sure can verify the ticket is valid in no time.Just a case of rip off britain once again.

  • Hi there, I've read with interest the comments on this site regarding these Parking Tickets which have no legal basis it seems. I visited someone and parked up in a space marked with yellow crosses, known as an emergency space (not it's official title, just something the residents seem to call it), since all the visitor spaces were taken (by residents who prefer to park in them). There were no signs anywhere saying what this space is used for so I parked there, since it was the only available space. The next day, I had a ticket on my windscreen.

I followed the advice on this site and have totally ignored all correspondance from these theives.

However, I have received a more strongly worded letter recently threating "possible" court action. I have tried to attach the image but it's not allowing me as a new member. It is from:-

    Car parking partnership
    Northampton
    NN4 7XN
    Tel: 01604 625 613

    FINAL REMINDER

It talks of debt collectors, CCJ's etc... etc... and wants me to pay £100 quid.

    Civil Parking Notice: CPxxxxxxxx

I tried everything to get the scan I made of the letter to upload here, no luck!

Please let me know if I have anything to be concerned about? Please confirm these are the right guys to be ignoring :->

    Thanks a lot
    Great forum
