    Coblcris thanks for your response!

I either misunderstand or I havent been clear in what I said re the DVLA and my name.

My full (as in birth name) is on my driving licence.
My nickname was used by the garage to register a car they owned and then sold to me to register me as the new owner. So on the car `log book` my nickname rather than full name appears.

The DVLA records, if searched, would show my nickname as the registered car owner....and that how my name appears on the Ntice I rec`d today. If searched for driving licence details...a different name would appear.

Maybe I was/am having a `blonde` moment....but I thought maybe if anything `kicked off`...particularly legal proceedings...I might just be able to `escape` because my nickname is not my legal name....

Does any of this make any sense??

Eminently so. I made an invalid assumption.
    My sincere apologies.
    And my thanks.

    Sir Rodger...thanks for your reply.

I was thinking that the photo, if it could show me clearly as the driver...would provide evidence against me.

No. They can't just turn up at court with a photograph hoping they've sued the right person. It doesn't work like that. Anyway, even if they know you were driving they still have to prove that the amount they are asking for represents damages and not a penalty. That's why they never go to court!
    Carry on ignoring.

Pepipoo is reporting that Trethowens and the Aintree Hospital lost in court today over a parking ticket. They lost on three counts:-

The lines were covered in snow, the question of the driver knowing or not knowing about the T&Cs, and the sum demanded was deemed an unfair penalty.

There is an excellent article in today Sunday Post (Published in Scotland) about private parking tickets. The main part of the article is about the DVLA selling information to PPCs and the fact that both the AA and the RAC are calling for this practice to be banned. And the journalist only used the "f" word once!

At the bottom of this article is a section explaining exactly the facts about parking on private land. It could have been written by somebody from MSE or Pepipoo, it's that good. It outlines the fact that PPCs can only claim for the actual losses suffered, and that they can only go after the driver and not the RK.

Just seen that too. It's on page 43, if anyone is interested.
  • Hi everyone I'm looking for some help. I drafted my appeal letter before reading this forum now I am unsure whether to send it.

Basically staff aren't allowed to park in the metrocentre carpark but the only signs are at the entrance and I genuinely hadn't seen them until after I recieved the parking ticket and was told by someone else at work that there were signs up. The metrocentre website say they provide "safe, free parking" and mention nothing about staff parking (but I did buy some stuff in my break so was technically a customer).
Also the ticket says I my car is white but it isn't.

I have recieved my first letter from town and city parking, however, have parked in metrocentre carpark several times since recieving my ticket and haven't had anymore. Do I ignore? I don't want to go to court for the sake of £40 and people at work are saying if I pay I won't be able to park there again and I have no other way of getting there other than driving.

Should I appeal with the points listed above... mainly that the ticket person was wrong and I don't own a white Clio or do I do nothing?

Yes you ignore, it is perfectly safe. :D

No they can't stop you parking there (the landowner technically could - but you work there, and the fact your car received a mickey mouse ticket doesn't mean YOU received it, who is to say who was driving). I got my ticket over a year ago in a Supermarket car park and I go back every week. The car park goon who issues the fake tickets doesn't know who does/doesn't have a previous unpaid ticket - and even if he did he can't do anything about it!

Your colleagues need educating - this is a scam and no-one should ever pay a fake PCN. In fact I would honestly be parking there every day if it were me and I was a staff member - stuff Town & Sh!tty (they are well known scammers, parasites using the retailers to make money akin to a protection racket. Why shouldn't staff park there !!!!!!?).

No, there's no point appealing. Three guesses what the answer would be?!

IGNORE IGNORE IGNORE IGNORE! Then ignore the scary threatogram letters as well.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks.. and no most of my colleagues don't pay them but I have a feeling they do keep a record of who works there as someone apparently got a ticket everyday for a week (she went to see management to complain) but nevermind maybe mine will just go away... hopefully he'll be looking for a white one.
There is a sign at the entrance though which says staff can't park there.
  • Just after some help as I don't know what to do about it.

I was issued with a parking ticket on 21 May by a private parking company, it was issued because I'd outstayed my time by approx 10 minutes, which I openly admit that I had.

I've written to the company and expalined why I was late getting back to my car.
On the 6th March, just over 2 months before being issued with the ticket, I was admitted to hospital to undergo an operation on my left foot, which took a very long time to heal. The day I was issued with the ticket was my first proper outing since having the operation and being perfectly honest I just innocently misjudged just how much the outing would effect my foot. My foot had swollen twice the size and I ended up having to limp in a lot of pain back to the car. This outing resulted in extreme swelling and pain up until attending a doctor’s appointment on 09 July (approx 6 weeks after the outing) (I can get my doctors notes proving this).

As I said before, I've written to the company (using one of the templates) to explain, I also included, as advised, a copy of my income proving that the £100 that they are asking for is too much for me to pay, also a workings out of how much I should really pay for staying an extra 10 minutes "the £100 charge you are asking for far exceeds the cost to the landowner of £1.10 per hour; to justify this £100 charge I would have needed to have stayed for approximately 90 hours". And, also, the time the ticket was issued, at 4.50pm, the car park was empty and I was not preventing other motorists from being able to park. I also included a hospital discharge letter to prove I had the operation.

I've received a reply saying they've taken everything I'd written into consideration and have declined the appeal. They stated that 'It is the motorist's responsiblity to ensure they purchase enough time for the duration of their stay and to allow for any unforeseen delays'.

Is there anything I can do? I really can't afford to pay what they are asking for and have seriously considered just to let it run it's course until I end up in court. I really wish I could go back to that day and not bother going out at all.

    Many thanks.

What you do is ignore them from now on. You do not owe them a penny. Their "appeals" process is just a sham, as it's not independent. S0 please don't contact them again. What parking company was it, as we like to name and shame on here?
