Independent Enforcement Agencies are acting in the spirit of the DDA by issuing contravention notices to people parked without a blue badge.

Ignore this poppycock. If you didn't display your badge, then pay and remember to display it next time. We live and learn.

We all live and learn and one of the first things we learn is to ignore posters who peddle lies and deceit in order to extort money from innocent victims.

We also learn that some PPC companies have staff literate enough to post on public forums to defend their underhand tactics.

'Independent Enforcement Agencies' - no such thing. A figment, a will'o'the wisp, a phantasm.

'are acting in the spirit of the DDA' - are acting directly against the DDA

'by issuing contravention notices' - there has been no contravention whatsoever

'people parked without a blue badge' - the blue badge scheme does not apply.

Once again, every statement by Lurking is in diametrical opposition with reallity.

I just love the way you followed your own ridiculous sound bite with the reply you know we were all going to add: 'Ignore this poppycock'! :rotfl::rotfl:

So we will ignore your poppycock, as ever. :D

It's simply not possible to 'act in the spirit of the DDA' as it's an Act of strict compliance for retailers. You discriminate against a disabled person then you break the law - simple.

You lot potentially BREACH the DDA every single time you issue a fake PCN in a disabled bay as you have no way of knowing - and no right to ask - whether the driver, or passenger, or a person they've come to collect, fits the DDA definition of disability.

This thread plus two other very recent UKPCS disabled bay examples I know of on here and on pepipoo forums are going to be sent to Helen Smith at Mobilise tomorrow. I'm emailing again because I'm not letting this ridiculous matter drop - IMHO Mobilise have been had - hook, line and sinker, by a parasite.

    And to Carl7638
, don't even think about doing either of the options you've stated. If I read your post right you're thinking of paying in full or taking up their offer for a lower 'fine'.

Private parking companies cannot issue nor enforce fines. You must not pay this - would you pay a phishing emailer?! Did you realise private parking tickets and the threatening letters which follow are just like an email scam, only carried out by letter?

You owe nothing, this is not an offence. It's a private company asking you for money.

Any alleged contract to display a Blue Badge on private land is null and void because the Blue Badge scheme only applies on the public highway and Council Car Parks.

Think about it, if they had signs up by certain pink-painted bays saying 'only women can park here' would you honestly believe that it would form a valid contract? Just because they put some signs up? No, it would CLEARLY breach the Sexual Discrimination Act because you cannot stop others parking there, or you break the law!

The signs you saw breach the Disability Discrimination Act because you cannot stop other disabled people parking there (what about foreign disabled visitors, for example, or someone who has just been diagnosed with cancer, for example - the DDA covers them from the VERY POINT of diagnosis).

The Law takes precedence over any signage, I am sure you'd agree? The DDA allows ANY disabled person to use any disability 'adjustments' made by a retailer, e.g. disabled bays in the car park.

You don't have to fight the company - but hey, you could do! A complaint under the DDA would be warranted (illegally discriminating against you, a disabled customer who fits the DDA definition of disability). And copy in your MP, Trading Standards, the OfT - I'm sure they'll be very interested in the scam debt collector letters that you'll have to endure for months on end.

Don't let ANYONE tell you that the signs 'form a contract'. They don't - as they breach the DDA.

The easy alternative - ignore the 'PCN' & ignore the letters pretending they'll take you to Court.

And if you choose to join Mobilise, do so on their website (someone said yesterday it costs £16!).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Lets try and be nice to our new pet troll. Tell me Lurking Enforcer, do you have you own high viz tabard? Does mummy let you wear it around town to impress your friends (assuming you have got any)? I am sorry if my friends have made you cry, they have very little understanding of the pressures you face in your meaningless minimum pay McJob.
Still waiting for Parking Eye to send the court summons! Make my day!

I bet he has his own uniform jacket to dress up in, and a little hand-held [STRIKE]toy phone[/STRIKE] ticket machine with nice big pushy-buttons on it as well!

Boy do I laugh when I see one of those sad gits in a private car park. Sometimes I strike up a conversation with them for my own amusement and to see if they actually have a brain. So far all the evidence points to the answer being negative.

Just got my final warning from Graham White. Is this the end of the matter now or are they likely to continue pestering?

Match your letter to the Graham White letter-chains shown.

You'll miss 'em when they stop wring to you (I miss Euro Car Parks, thought they'd have made more of an effort really, 3 letters was a poor extortion attempt IMHO). :D

  • You may have to wait for a final, final warning! If they really meant business they would have taken action ages ago! Scammers are so predictable!
