What they should be really doing on a forum such as this, is helping people to pursue their appeals through the proper channels.
Non-payment is not just obstructive, it's extremely stupid. Why get a CCJ over it?
For as start the "appeal" is just a sham because it's not independent. As for a CCJ then the case would have to go to court(very unlikely) the person loses (very, very unlikely) and the person refuses to pay whatever is ordered by the judge. You PPC employees must exist on a different planet. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Not sure about a "dufferent" planet, but they may well exist on a different one.
Although, on the REAL planet, landowners can control parking on their land, and are backed up in court.
Believe forum prattle at your peril.0 -

Of course land owners can control parking, what they don't need is low life scum, and scammers to do so, all they need is a barrier, and people to pay on exit of the car park, so that is true reflection of usage.
People like you who are employed by the scammers must be real nervous considering you are being booted out of car parks because of greed and unethical practices.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
Dont want to sound cocky as i not, But lets just say thy picked on the wrong person when they planted a ticket on my screen with help from this lot on here expect to loose lots of money.
I work for a very large company with over 300 engineers working thoughout the uk, Most of our site are where these tickets are being used, Main places we go to include BHS, M&S, Tesco (main one),Morrisons etc etc We go to these places around twice a week where i saw just in an hour @8 tickets given out.
And thanks to one chappy on here is what i have been giving out everytime i go to any of the places we are contract to:
PRIVATE PARKING TICKETS - DON'T PAY!
IT IS NOT A FINE! YOU HAVE DONE NOTHING ILLEGAL!
This is an information page for the thousands of people who receive "tickets" from private companies in the UK ever day at supermarkets, retail parks, and in any other privately-owned carpark.
We are NOT encouraging anybody to openly flout parking restrictions on private land, or to refuse to pay reasonable charges for parking. Landowners have a right to make reasonable charges for the use of their land.
For advice specific to your case, you should visit the forums at http://forums.pepipoo.com or http://www.consumeractiongroup.co.uk...affic-offences.
1. What you should know about these companies
It is important to remember that private parking companies (or PPCs as they are often called) have NO OFFICIAL POWERS - that's right, none at all! They give out their "tickets" on the basis that you have seen the signs in their car park and that you have therefore agreed to a contract obliging you to pay a certain sum of money.
2. What happens to people who don't pay?
In 99.9% of cases, absolutely NOTHING! The company pays the DVLA £2.50 to get your address, and then sends lots of threatening letters. In the main, these letters can be safely IGNORED. The only way the company can actually force you to pay is by taking you to the small claims court, which costs them even more money. And they are by no means guaranteed to win! And they practically never do.
The two main reasons for this (among others) are the following:
- Only the person DRIVING the car could ever have agreed to any such parking contract. The company can only get the Registered Keeper's address from the DVLA: you don't have to tell them who was driving.
-Many of these charges are so extortionately high that they constitute a penalty, which is unenforceable in a consumer contract.
3. Can they affect my credit rating?
NO! The only way your credit rating could be affected by ignoring private parking companies is if you were taken to court, lost, and then still refused to pay. But they will not take you to court.
IN SHORT
The vast majority of the time, you can safely IGNORE tickets from private parking companies, they are not official fines.
The vast majority of the time, you can safely IGNORE the threatening letters, including those from debt collection agencies.
You DO NOT have to pay a penny of your hard-earned money to these companies. Remember that the chances of being taken to court are very slim indeed.
DO NOT IGNORE COURT PAPERS!
If you receive real court papers from a private parking company (very rare) then you should go to http://forums.pepipoo.com or http://www.consumeractiongroup.co.uk...affic-offences for help defending the claim. Do not be afraid to sign up and ask questions regarding any paperwork you are not sure about.

Thanks all and just to top it off all of the vehicles the company use are lease and this information has been passed to them (prob the biggest lease company in the uk)

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -

we live in a block of flats that have communial parking they have signs saying parking for residents only and above the visitors parking only permitted with a permit.we were fined for parking in a normal bay for residents and paid the fine [our mistake} we yhen contacted the company by mail with appeal against the fine they would not refund even allthough we are owners of the property.
we then contacted the lease company who after numerous e mails and phone calls told us that we had an allocated parking space but did not know which was ours.
in between this time we again received another ticket while in the visitors space to which we refuse to pay ,has the car had broken down and we were awaiting a mechanic who repaired the car next day.
we have told the parking company that on the evidence we have about the delays we are willing to take the matter to court
how do we stand in this mater:(0 -

1. Re the most recent ticket, all you have to do is ignore it as per all the other threads & advice on this board! It's a scam, it's just a mickey-mouse ticket.
2. Re the ticket you paid, you could take the parking company and Managing Agent to Court to get the money back, as per the Susan Pratt case:
Susan Pratt case (she paid a fake PCN then claimed it back in Court)
So it's up to you, the most recent ticket is easy to ignore, but the Court case to get your money back for when you fell for their scam will take more effort but can be done.
The PPC won't take YOU to Court, their letters will pretend they will - but it won't happen.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
