    Ah right that is good news then...yes to be fair the info I found on Parking Eye was on other sites.
    Ah did you find their fake "forum" that you can't register on with people saying they take people to court and their fines are enforceable etc? :rotfl::rotfl::rotfl::rotfl::rotfl::rotfl:
  • Ah right that is good news then...yes to be fair the info I found on Parking Eye was on other sites. I think Ive got a fairly strong case...Im not going for the ignore tactic as I am so infuriated with them that the urge to point out all there flaws and slip-ups is too great to ignore!

    Do you think they'll be bothered? They will just put you down as a worrier and it will take a lot longer before they leave you alone. Ignoring is the best option.

    We know the feeling but you must resist the temptation. Whilst we all hate the ppc's we all normally pay where requested and ignore them when they overstep the mark.

  • I got issued with a ticket last night whilst at college. I'm confused between the official information on this site and other peoples thread answers.

    I got my ticket at half eight on Thursday night. I was parked in a car park for Bakers Oven or Greggs or some such baked goods shop. I think there was a clear sign which stated there is no parking at any time and the car park is for staff of said bakery only. As I'm at night school and bothering nobody I didn't think it would matter.
    The ticket states I was parked outside Dorothy Perkins and owe £75. On another thread this was posted:
    They have to show actual loss - this will only really occur if you have taken up a space in a full car park - not paid or overun. Again they will need to show that the car park was full and they turned away potential car parkers. Alleged increases in what you owe because you did not pay in time will not wash. They are potential unfair contract clauses, that is if they can show a contract exixts. Again District Judges can see through this ploy to try to up the value of the claim.
    As I did not cost the company any money should I too ignore the ticket? It was definitely issued by a private company though I'm not sure which one.

    It must say somewhere on the ticket, otherwise how could you pay
    ( assuming that for a nano-second you would even comtemplate doing so)

    Yep, the advice is just the same as all the other PPC threads on here - ignore completely.

    The info you've quoted from another thread is correct. Basically any charge which does not reflect their actual losses (even if it's written on a sign) will be deemed by a court to be an unenforceable penalty. This has been the situation at common law for 95 years.
    In 99% of cases, their actual losses will be zero or a trifling amount that's too hard for them to prove.

    If you're referring to Martin's official advice, we're all disappointed that he's not simply advising people to completely ignore PPC correspondence. There really is no point in "appealing" or trying to reason with them as they have no legitimacy in the first place, and hence you owe them no explanation or money. The burden rests on them to convince a court that the Registered Keeper was driving and that their charge is a true representation of their actual loss (the chances of them doing this are akin to your chances of winning the lottery).
  • I received a letter today from Town and city parking, stating that I receievd a parking ticket back in October. I received no such ticket. They also state that my car is blue but its black and that they want £70 off me. What should I do?

    Do like everyone else, just ignore them. File the paperwork away and forget it. Read up on all the private parking companies which you can do using the search button.Anything unusual then ask again and we'll do our best to help.
