  • I responded to a PCN using the letter on this site, stating i wasn't the driver at the time, which i wasn't. I have just had a letter back from the company called parking eye stating " as you are the registereed keeper of a vehicle that failed to comply with the parking regulations, we are entitled to assume that you were driving the vehicle on the day in question. Therefore unless you are able to provide satisfactory evidence to the contrary, we are entitled to persue you for the payment of the outstanding parking charge"
Should I now send the second letter back as i have started correspondance with them or just ignore it completely?

    This statement is meaningless :-

as you are the registered keeper of a vehicle that failed to comply with the parking regulations, we are entitled to assume that you were driving the vehicle on the day in question.

They might as well say that Jesus wants you for a sunbeam. They can't prove either proposition. Just ignore any other correspondence from them.

  • Hi , I wonder if anyone can offer me advice . I was recently ticketed for parking in a private car park next to my work place. It isnt open to the public and there are signs pointing that out. However I had been told previously by one of the ticket issuers that if i put a sign on my car saying i was working at the pub opposite he wouldnt ticket me. Obviously that was a lie or someone else was out that night. I ignored the first ticket (£80) but wrote to them after i recieved a demand for £120. I pointed out that I had been told i was allowed to park and that It couldnt possibly be costing them anything as the premises were shut for the night. I also believe the times on the ticket arewrong , though i cant prove this. I also told them I cant afford to pay. I was then sent an oficial rejection and given an extra 7 days to pay. Its due tommorow and im tempted to pay , should I or just ignore everything from now on ??? The company is vehicle control services from sheffeild.
  • Hi, i had a parking ticket last year from a free car park and wrote a letter claiming that under the unfair contract terms act they couldn't enforce a fine of £60, but they sent a letter back stating that the unfair contract terms act doesn't apply to this situation.
Is this right? or was i just fobbed off?

It depends if the car-park was run by the council or by a private company. If it was a private company it wasn't a "fine", just an unenforceable invoice.

I've just had a PCN from those numpties at Newham. It's basically a photograph of my car waiting at the junction, (front wheels are clearly not over the give way lines), where a left turn is not permitted.

They are claiming that I made a illegal left turn into a one way street. My contention is that I did not, is the above mentioned photograph sufficient proof that a contravention took place? And having had a look at this junction there does not seem to be any camera fixed at this spot, so picture must have been taken by peaked-cap man hiding somewhere.

I'd appreciate if anyone can tell me of my chances of successfully appealling this.

I received a ticket for overstaying my time at a supermarket. They sent cctv pictures with times for both entering and leaving the car park. However the times they state I was not at the car park. My till receipt shows a time before the time they say I entered the car park. They could of course say that I did not leave immediately
However I did probably exceed the amount of time that I was parked there
I'm not sure that this circumstance fits any of the 5 reasons for appeal. What opinions do you have on this?
    Thanks

There is no appeals process with private parking companies, they are just trying to scam you out of your money.

They will write lots of threatening letters, all of which are complete tosh as this is not enforceable in law. Ignore them all, don't pay them a penny.

Oh, and please start your own thread for your own case.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Umm I would have started my own thread, but it looks like you just add to the end of this one and as its 6 pages long it doesn't relate back to the original poster. Its a bit confusing
