    Money from cashback sites are not free as some of you put it. Cashback site doesn't pay you, it's the company who you have spent/registered gives the payment to sites who pays you.

    I not sure why some of you guys haven't taken the legal route with these cashback sites yet, I would of done if big payment kept getting delayed.

  • I think the answer is kind of contained in your question: it's difficult to take legal action because the cashback sites will say that they are just acting as the middleman, chasing payment on your behalf, but if they don't get paid they can't pay you.

    I got caught with this a while ago with Easymobile. Only signed up because of the cashback deal, they were slow to pay, so I never got my £60.

    One way around this would be if the cashback site offered some kind of guarantee that provided you qualify at the time, they will make up the shortfall if the company goes bust or can't pay. If one of them offered this they would get my business!

    The cashback sites are as you put it 'the middleman' . So they are responsible for the payment, your contract are with them not the companies directly. I wouldn't let them fobbed me off like you guys. Also I would not hesitate to spend £30 and proceed the legal route if I had big payments like you guys delayed or not paid for such unreasonable time.

    Not for a moment defending them - I would love for someone to take them on and win - but I think the link demonstrates just how much "wiggle room" they have created for themselves. But then I'm no lawyer...

    Quidco and other sites can have as much terms as they want. They are acting as an agent so your purchase contract are with them so to speak without warranty of products/services from them.

    As consumer we have statutory rights, by them breaching the original terms means we can pursue throught the legal route.

    Note that all transactions you make are not with us, but with the individual retailer. 100% of all credit we earn from retailers which can be traced back to you, will be credited to your account.
    We cannot be held responsible if the retailer fails to report your sale to us.
    Retailers have their own rules upon which they determine transactions to be genuine

    These are the terms for TCB - it's not as simple as writing off the Terms and conditions, quoting the law - the law is designed to protect a consumer. To be a consumer you have to actually buy an item or service. The cash back sites get you to sign what is essentially a waiver to your rights saying its not them providing the cash, its the company you make the purchase with.

    Everyone can refuse to consent to the terms and conditions when they set up an account with cash back companies. By accepting them, you are accepting their terms, and their terms state its not their problem.

    As a result, their lawyers would walk all over any case you tried to bring against them and it would be throwing good money after bad.


    That said, nothing to stop you trying it with the retailer themselves! :D

    if you have problems with cashback sites just go straight to the affiliate manager for the company concerned.

    The retailers are offering nothing, it's the cashback site who offer the cashback, and some charge a fee for this service. Any action needs to be against them, not the retailer.
    They do have T&C's, but are they actually legal??
    Until tested, we will never know.
