That's standard proctive Jim. They can't take you to court if no default has been issued so issuing the default just gives them that option should they want to pursue that at a later date. It's only saying the MAY take you to court - not that they WILL.
As the original agreement was broken, this is why there is a default. Any subsequent agreement and payment has no bearing on the orignal agreement which is why they say payments have not been made. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Do you have an arrangement with them or are you paying thru a dmp? If you need help or advice please ask.

Hi Jim, hope you are OK today. Did you survive day 1?
MBNA are a sore point for me at the moment. I started doing a DMP myself, then started doing it via Payplan from August. But I called MBNA when I got the notice to say that funnily enough, I can't pay what they want - and the beep I was speaking to said they are looking at putting a charging order on my property.
currently the weight is dropping off with all the worry; no doubt it will pile back on again soon.
sorry, this is such a negative post. just feeling bad about it all at the moment.0 -
I would check this site out for info on charging orders and mbna. I have come across some very interesting threads recently. This has been something that mbna has never mentioned to me, although I've heard noting more since the default notice touched down although I have until 24/09/09.0
