A no spend day, I have those mon to thur some weeks ! Petrol on Friday, aldi on sat and Sunday newspapers on, well Sunday! I've had accounts with mbna since around the 90's, the most recent card I would have got in 2000/2001. I have seen articles in newspaers regarding the debt not been enforced. Ethically this does not seem right, I spent the money, however if something has been documented inccorectly what harm can it do to find out ?0 -

What is does is force MBNA to accept your DMP and prevents them from CCJs and charging orders.
Frankly, the law is over 30 years old, so any company who cant get that right deserves a kicking. If you do not respond to a CCJ threat in 14 days, you are stuffed. Why should they get 30 years and still be allowed excuses?If you've have not made a mistake, you've made nothing0 -

The problem started when I had a £2k paycut last year, up until this point I was just surving ( I live on my own ) since then with increased mortgage payments (I am 100% up to date with mortgage and am never late) higher food and fuel prices it has been a real struggle. I have taken a second job but all the increases in costs over the last year have not made it any easier, I also rent out my spare room.
I can't see what else I can do and am in such a mess I fear that they will come and evict me and take my flat.
I s there anything I can do, or is it to late. I am tired and feel a faliue, I have worked so hard and all my dreams and hopes are lost. I know i've rambled . sorry.

Fair point, I haven't had any nasty letters from them yet but when I do I should ask for a copy of the credit agreement? How does this force them to accept the dmp?0 -

If they do not have a correctly documented CCa, then they cannot enforce the debt throught the courts, at all. Your sole defence is that they are not legally entitled to collect the money.
What this means is they if they ask you to pay more than on your DMP, you can refuse and just remind them that since you are not legally obliged to pay one penny, they need to be grateful for what they are getting.If you've have not made a mistake, you've made nothing0 -

I panicked like you and finally (after over 12 months of ignoring letters)plucked up the courage to ring CCCS, they were so helpful and friendly and have been on a budget plan for over 4 years, only occasionally do I get a letter from one of my creditors demanding full payment but CCCS assured me that as long as I am paying them an allocation out of my disposable income to ignore their threats. Do give them a ring, you will feel so much better.0 -

I just wanted to echo what many other people have already said, you're a real inspiration! When I read your first post it took me back a few years to when I was in a very similar situation to yours. I went on a DMP with Payplan, and I can honestly say I have never looked back! I'm so pleased to see that things are starting to look up for you. Thanks for your support Lovella ! At first it does seem like a daunting task but once you get started you realise that you can deal with the problem.
