We have recently had the dubious expereince of being taken to court for a charging order and have learnt more than we ever wanted to know about them! As stated here the court would not put a charging order on her house for his debt. That would be grossly unfair whatever the circumstances. From the sound of it your ex is never likely to put his name on anything that you could make any claim against-he is obviously determined to evade his financial responsibility to his children and will use whatever means he can to protect his sorry backside. After 12 years I have given up trying to make my first ex husband pay what he owes-it takes too much out of you in the end. I am just glad he is kept a relationship going with the kids (having said that he has been awol for the last 5 weeks lol!) The only time the CSA seem to be succesful is when they have a sitting salaried duck like my second husband. I am so sorry to read of the difficulty of your situation he should be thoroughly ashamed of himself. My younger son had a charging order on his house from a debt collecting agency. He contacted a solicitor and it was set aside.
My son only had a contractual obligation to pay the creditor (a bank) and not a debt collector.0 -

Could this be the end of my adventures with the CSA?!!! :eek: My first payment under assessment is due this weekend - I agreed to direct payments from XHTB, until/unless he fails to pay. If it arrives, then that will be it apart from me trying to claim a special payment. If it doesn't, I have been given the number to call and they said they will implement a DEO straight away.
So hopefully I can be of help on this board but won't need help anytime soon. Thank you to so many for their advice, pm's, support etc - it really made a huge amount of difference to me. Now fingers crossed that you don't see any more adventures

have you set up a standing order? can take 4 -5 working days to clear between accounts depending if theyre with the same bank etc
Hope it all goes to plan, im sure your xhtb realises its in his, yours and your child/rens best interests to make payments a priority

Same bank, so any transfers show on the same day - so basically I can see straight away if he does it or not!! I used to think he realised that assisting with her was a priority, but based on his behaviour the last six months I'm not sure that's the case

some people dont realise what theyre missing out on, hope things begin to improve - have you tried talking to him about things? he may not realise how hes being?

Thanks Tamsin. Conversation not easy as he automatically assumes that blame is being assigned, whereas I just want to get on with life as best we can!

Well 2 months since assessment, and 2 month's of payment :cool:
Called the CSA complaints section today to start the ball rolling with the financial redress. Spoke to a very helpful chap who said it would have to go back to the Complaints Officer who was dealing with me originally. I gave him all the facts, and he said he can't see any problem with them sorting out financial redress, but obviously not to start spending the money yet :rotfl:
