Strange letter from a Debt collection agency! re:SKY

Lowell was requested to supply a copy of agreement by 24th Feb, but I never heard a thing UNTIL today :mad: :mad:
Hubby as just received this letter saying......
1)They have discussed the account with Sky, who have said that the balance has accrued due to hubby NOT returning the signed contract. They say they sent out various letters and packs which enclosed the contract and advised him that if it was not signed and return the veiwing would be blocked and his account applied with equipment and istallation clawback charges.
(Hubby insists he returned contracts, this was an upgrade aswell not a new contract with Sky and that his viewing was not restricted)
2) Lowell state that it is written in the contract he has to have had the epuipment etc for min of 12 mths, if t&c's broken he would have to pay full charges for equiptment and installation.
3) They then state...'As a result of the above, we are unable to supply you with a copy of the signed cantract as you did not return it to Sky.Even thoough you did not sign and return the contract, you have been bound by the terms and conditions of the contract by:
a)Confirming their consent to the sales person to having 'Sky'
b)Allowing the equipment to be installed in your property
c)Allowing the viewing card to be used to receive 'Sky' services '

They they go onto say that they hope this clarifies the situation( :mad: ) and as a gesture of goodwill to help him resolve this outstanding matter they are pleased (!) to offer him a reduced settlement with a 40% discount giving him a 'new' balance of £179.94...offer open for 7 days from the date of letter bla bla bla....
SO....................now what can we do...just pay up and try and forget this horrible mess? or carry on fighting? also, how does he stand legally, since they saying just having their services without contract, is still enforcible to get supposed account balance?

Even thoough you did not sign and return the contract, you have been bound by the terms and conditions of the contract
If you haven't signed it, how can you be bound by it? They're trying it on. No contract - no debt. Tell them you'll see them in court.0 -
Can you get copies of your bank statements from the account that the monthly subscription would have been paid from to show that you paid?
They are really shocking an I hope you get this resolved.

Unfortunately Murtle this so called 'debt' is from 2001/2..so no records of bank statements, mainly he isn't that organised to keep them for more than a few months (nor me b4 discovering MSE!), plus his bank account he had back then has been closed for at least 3 yrs0 -
how long do you banks hold the statements from?? I thought they'd have them available for 7 years? He may have paid the monthly charges, then they couldn't claim anything, even if they didn't have the signed form, that's just tough. They are useless though, as I had to send back the signed form a few times before they accepted that they received it....there must be a room at Sky HQ where letters get dumped when staff can't be bothered to deal with them anymore!!!!

well his old bank account is closed so I don't think they would still have records from 4-5 yrs ago....
Hubby thinks he should offer them £100 to get rid of them....I don't think he should as it's not a debt he owes... :mad:0 -
We had a problem with Sky a few years ago when we cancelled. We told them to downgrade our package as we wouldn't be using it anyway for the 30 days notice that we had to give and were told that we couldn't cancel and downgrade in the same month. This ended up with a bill from them for £19.50 which we refused to pay. We asked if we had asked to downgrade then cancel would they tell us that we can't cancel as we had just downgraded?
This got passed on to a DCA and I wrote to them explaining this and they told me that they would contact Sky and if I didn't hear from them again that it had been sorted.
Never heard from them again but we went back to Sky earlier this year and when the first bill came in there £19.50 on the bill but when I spoke to them and explained it all they told us just to ignore it and pay the rest.
I would point out to them that they supplied Sky to your HB for over a year so if he hadn't sent the contract back then why didn't they block his card?
I think the bank might still have some statements for this old account, I think they would keep them for several years after the account has been closed.
I definately wouldn't pay them a penny, it looks like the paperwork has been misplaced by them so why should you have to pay for their mistakes and surely they must know that they supplied him with Sky, they should have a record of the viewing card number that he had and be able to trace his viewing through that.0
