    The first letter i received about this was certainly over 30 days ago BUT the letter (supplied by Harrassed), was sent recorded delivery, asking for proof of a signed agreement, but it's not been 30 days since it was delivered!
    I'm not sure what to do if we don't hear back, i'm in the mindset that if they haven't replied etc, not to rock the boat and presume that they have decided against trying to collect this alleged debt BUT if they come back demanding money again after the 30days legal required time, and have not provided proof (which of course they cant!!)...I will then take the matter further!!

  • Lowell are in the news at the moment for harrassing the family of a dead man even after they had repeatedly supplied proof of his death!

  • How did you get on with this? I have been following the thread then it has dried up.
    I really don't like to see these bullies get away with flouting the law.

    Hello to all,

    Well, would you look at that!!! Lowell on the news eh! I am certainly not going to let them get away with this...who knows how much money they have had from people already. I sent my recorded letter with requests for statements on the 20th Jan. They replied to this on 26th Jan. they originally wrote to me on the 11th Jan.

    I will fill in the form that Harrassed suggested and get it ready to send on the 30 day mark. Anyone else thinking of doing this as I hope to expose them n a wider scale - they picked on the wrong people this time!

    Which means they are about 14 days late in complying with the Consumer Credit Act. Even if they did get back to you now and then go for court action they would still have to explain the delay to a judge who may not be impresed by their actions.

    If they do not respond within the 30 dyas report them to Trading Standards (you local council) and copy the Office of Fair Trading.
  • I received a letter from Lowell, saying they have ordered statements and agreement through Lloyds on 31 January and heard nothing from them!

    At the meantime I ordered my credit reports from all three credit reference agencies and no entry regarding this outstanding balance.

    I agreed with KAJA to write to both Trading Standards and Watchdog as advised by HARASSED. 30days is from the date of my letter???

    My letter said this too....

    "statements have been ordered from Creation FS and will be forwarded onto you shortly. Please note that upon receipt of the statements, the balance must be paid in full". (cant be bothered to drag letter out, but it was along those lines).

    When I called Lowell, he told me he was looking at my statements. The letter was from someone named Nigel Beaven. I called them up again a few weeks ago and told him to call me back...he didn't...

    roll on 30 days...

    its Kaj by the way...admin havn't sorted my user id out...

    Our letters were from a 'Nigel Beaven' too :rolleyes:

    They haven't even contacted us since we sent the letter...even to say if they received it or that they were trying to get statements/contracts.

    Might be calling on some help to compose a letter to Trading Standards and Office of Fair Trading! :o
