I ,too, received a letter from Lowell Portfolio I.
The exactly same letter as kajalnishapatel received, with original creditor : Lloyds & Balance Outstanding : £1685.
I haven't used this account with Lloyds for more than a few years so I called both companies.
Lloyds informed me that my account was closed in 2003 with the last entry of £1685 OD & they sent me letters asking about this OD to my old address (they didn't have my current address...) but they can't see any more information than that and told me to contact Lowell.
So I called Lowell who couldn't inform me how I owed this money either and asking me to contact Lloyds.....
Will the letter Harassed advised to kajalnishapatel work in my case???
Any further tips/advice would be appreciated.

Yes, although it's not strictly speaking a credit agreement. You will have to amend it somewhat. They still have to provide proof of the debt and the assignment thereof.0

Thank you for your help and your quick reply, Harassed. Much appriciated.
Could you pls tell me how I could amend the letter?
As if I change something, the laws you indicated may not apply.
Thank you!0 -
Hi Thorpe,
Lowell contacted me at a previous address too. I found this very strange, as my experian credit report has my parents address and the storecard linked. They could have caught up with me by now if they wanted to. Also, when I called Lowell, they told me that the balance outstanding could be a result of interest charges. I also find it strange that all of a sudden, this has been sold onto a debt collection agency, as it has never appeared as a debt on my credit report. Furthermore, the address they decided to contact me at is still owned by a family member, so I would have been given any pervious requests for payment.

It depends on the overdraft. Was it within agreed limits? If you went over a certain amount, did another interest rate kick in?
If so, then it's a credit agreement and the letter applies. If not, then post again, I'll post an amended letter.0 -
Hi, Kaj. Lowell has my current address, it was Lloyds who had my old address!
Hi, Harrassed. Thank you for your reply.
My account was a graduate account with overdraft limit of £1500. I had some money in overdraft back in 2001 but then I believe I paid them back. In this case your letter still applies?
Thank you for your help.0 -
Yes. The stipulation for increased interest (which they presumably charged) above £1,500 brings the agreement within section 10(3)(b)(ii) of the CCA 1978 and it is a consumer credit agreement.0

lol since this was my original post I thought I would update
Sent Harassed's letter recorded delivery this week....awaiting reply...
*Fingers crossed*
We're getting letters and 'contact cards' from them twice a week stating hubby has not contacted them....which we have....just not acknowledged the debt!:rotfl:

They should supply within 12 days. If they don't supply within 30 days, they've committed a criminal offence.
As it doesn't exist, they'll have a hard time.0
