it might be worth a phone call to them to check if they have the statements. In my head I have 7 years, but then I'm writing a stats assignment and my brain could well be fried

Just received a letter form Hamptons Legal, they have been passed thi8s account fomr Lowell, and have used the usual we will take u to court if we don't here from you get CCJ etc, incurring more costs etc.....
I'm sooooooo tired of all this bother!!! the reduction they offered is not valid any more and are demanding £299 in the letter...
so all the letters and requests of contracts/agreements even though they can't produce it , but say he accepted goods and services therefore THAT'S the contract.....I feel we are on a losing battle here!
What do we do now? contact this 'legal' company and negotiate? or go to court and probably get a CCJ??

My bank - Natwest, advised on the phone that I should be able to go into a branch and ask for transaction detail from statements from up to-they believe 7 years ago. The information may need to be ordered but should be retrievable.
Not sure who/what your bank is like, but may be really worth him asking his bank to see if they have the information.

A credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
Says it all. You do have to defend the action, though.0 -

I have spoken to hubby and we are 'resending' the 'prove you have a signed agreement' to THIS company and see what happens....hubby is quite happy to go to court over this now, he seems as fed up as me about this situation!!0 -

used to work for lowell, they dont take anyone to court over their sky balances and if you just ignore them and they havent got yout telephone number theres nothing they will do0

We got a threaten court action letter on friday, respond withing 3 days etc.:mad:
I called up on hubby's behalf, did not admit to debt etc, and was told that the payment of £1 in January was his acknowledgemnt of debt!! :mad: That payment was postal order for copy of a signed agreement!!:mad: :mad:
I'm sooooo cross!! so looks like they have us over a barrel now!!!0
