Hi,
I don't think they have got you as the letter you sent stated what the £1 was for. So if they go to court you will be able to prove that the £1 was not a payment, but a postal order for access to informaton to cover their costs.
I wouldn't worry about it and don't bother to call them again, waste of good air!

Hi again,
It might also be worth sending a letter to the Financial Services Authority (https://www.fsa.gov.uk - i think) stating that they won't send you proof that you have a debt with them and that they are harassing you. This will scare them as they are licensed from the FSA.

TY for your advice
The dispute remains over the signed contract, they were not able to provide a signed agreement BUT say that as he took receipt of goods (ie digi box)and had viewing time accountable for he is therefore liable to it and would stand up in court of law as a contract between the two parties even tho no signed copy of an agreement is available....*sighs*
They have offered 50% F&F settlement tho....when talking with me earlier, but i am the wife, so even tho i didn't acknowledge the debt, Hubby certainly hasn't as he not spoken with them......0 -
personally after all this time I would let them take me to court. If they really thought that they had a rock solid case they wouldn't be offering to settle at 50% and would have started court proceedings long before now.
JMO and I hope it all gets settled in your favour soon. Good Luck0 -
Hi everyone...
Just to let you know, that after following Harrased's excellent advice, simply copying, editing and sending the latters he attached...Lowell sent me one last threatning letter and then said that they would be dropping the case!
one to me! perserverence is the key.
Now, my friend has received a letter from Hinkley Magistrates Court, saying he owes money for a TV licence. Firstly, the amount is wrong, it was hand-posted and part hand-written. Question: Can I use the same letter to send to them?
(following excerts)
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 ( s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
Thank you in advance...0 -
by the way, my alerts seem to have stopped, so sorry about all the clask responses. I kind of lost track of keeping y'all updated.
p.s. I did contact Trading Standards. Got one letter of acknowledgement, though nothing else. I assume they will be chasing it.0 -
I've also received a letter from this company claiming that I owe HSBC £490. But the account was closed well over 4 years ago and as far as I'm concerned not only did I have no outstanding debt , but, I had no form of credit at all?!? The one loan I ever had was to get rid of my overdraft and was paid off about 8 years ago. Once I was back in credit I never reapplied for overdraft facilities again.
How can I adapt the previously used letters to ask them for proof? As there was no credit agreement, what "proof" do they need to give me?
Cheers,
Bru
P.S. Harrassed, sorry to e-mail you as well as post this but my girlfriend and I are just starting to look for our first home and I don't need this affecting my mortgage application.0 -
ive had one too!
i actually put a post on the other day concerning this delightful company asking for £10.00 mught seem a bit stroppy to not pay it but as far as im concerned i dont owe it i have checked my file and there is nothing on there to state i owe it i havent lived at this address in the last 6 yrs so im not paying it! i have ignored them as i dont wish to acknolwedge this debt in any way so im waiting to see if they write again to which i will folow advise and ask for copy of original agreement made with sky

Hi there
I have just received a similar letter from Lowel about a claim on outstanding Sky debt, I panicked did a google search and came across this forum
I am in a similar situation in that I don't believe that I owe the money (they claim £312) however it was such a long time ago 2001/2002 that I can't really remember what happened.
I had moved into a property with my (ex) partner that we were renting from a friend while he was away in australia. We got sky installed and cancelled it when we left. I can't remember exactly the dates we were in the flat and Lowel claim that the debt is due to us cancelling the contract within the 12 month - however I really don't think I would do this if it would mean I would have to pay for something I didn't have. I really can't remember the dates. I have no paperwork from then to refer to as I thought that everything was fine at the time. Sky have never tried to contact me regarding this so I have not been aware of a problem. I am going to check with my bank if the DD came out of my account, but I'm sure that they came out of the ex's.
I'm really not sure what to do. I'm pretty sure I would not have knowingly breached the contract and I know that I ahve never been told by Sky that by cancelling I was breaching a contract.
Any advice as to what I should do would be much appreciated as I am really worried about this and that I don't have any evidence that I did everything within the contract terms
Thanks for your help

I had exactly the same letter and found out today that this company had done a credit search, are they allowed to do that without your permission?
