I applied for the loan online from what i remember. There are no tick boxes anywhere on the credit agreement. So, does that mean the PPI was included without consent and i have a claim?

    Many thanks

Not necessarily Egg may try and make out that you clicked or didnt unclick a box when applying on line.

So you can either write to them to ask them how PPI was selected or write and say you did not request PPi and wait for their response.
    What year was this?
    DS1 12/10/04
    DS2 13/07/06
    DD1 06/12/07

I tried to get money back from Barclays who told me I wouldnt get the loan without insurance. I have just had a letter from them telling me that they have done nothing wrong. Is it worth going to the Banking Ombusdman?
You can only go to the Ombudsman when they have sent you a "final response" or 8 weeks have gone by since you first complained. Is your letter a final response that they have sent? It usually says this is a final and you are free to take this complaint to the FOS.

I would say there is a good chance that if you did not ask for the PPI that it was missold to you. Was it just included and you assumed it was compulsory to the loan??

If it was then just take a look at the link here and see what you can add and delete from the template letter. Its always best to do your own from this. There are lots of reason on there for the misselling so pick out the ones that are applicable to yours.

You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

    Good luck

Thanks very much for your help.

I will go with the approach that i was unaware that i had agreed to take out PPI. On the credit agreement there is no form of tick box to confirm that i wanted it, or not. I cannot remember exactly, but i am guessing there may have been a choice during the application online, but it was so long ago. I'll send the letter and see how it goes.

Pinknico has replied about the agreement being taken out online and what year this was taken. Sometimes the tick box is online for you to either untick or tick....see the post above...;)

    Hi
Thanks for this. The original complaint was in Sept 2008 and they say in the letter that as far as they are concerned they have done nothing wrong and that if they do not hear anything within 8 weeks the case will be closed.

Its up to you. They will most definately have received it. Perhaps just ring and ask if they have.... . I would be very careful getting into conversations though...;) .
