I have a loan with MBNA and on the agreement it has:-
Cash Advance - £15,000.00
Insurance Advance - £0.00
Total Loan Amount - £15,000.00
Total credit charge for the loan - £2,531.24
Total amount payable for the loan - £17,531.24
APR - 6.5%
This loan ends September 09, but I am not sure if it includes a PPI. Can anyone tell me if I can claim.
Regards
Its does not look like you have ppi on it. You can also check your statements ppi would show on them but I don't think you have it.:wave:0 -

Re: Account number:
In the first part under the Data Protection Act 1998:
Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.
Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.
If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.
For the avoidance of any and all doubt, I reiterate:
I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).
If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).
Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.
I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.
I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.
You have 40 days in which to comply with this request.
This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.
Yours Sincerely
(thanks to our Laini for this one!!!)
This may make you feel more secure in making the complaint0 -
Hi all, this is my first post on the forum, although i've been reading and learning from it for a long while.
I have searched many threads, and have not yet found an answer, i would like to know if anyone has made a successful PPI claim against Advantage Finance Limited car finance?
But more specifically, on an agreement that started before car finance was regulated by the FOS? (Policy taken out in 2002 and settled in March 2005)
I was told years ago, when i was young, skint, foolish, and in need of a new car that i would not receive finace if i did not take out the PPI.
I'm actually a member of the Armed Forces, and therefore my wages are guaranteed, regardless of whether i am ill. This topped off with hoards of Personal Accident and Life Insurance (goes with the territory) i really don't need any payment protection.
Any information is greatly appreciated, positive responses eagerly anticipated!
Hi there
(Marshallka apologies if you have responded to this)....:o
Right, first thing is first, google in "Companies house" and a company search can be checked to see if that finance firm is still active, if so I would write to them with a help of a reclaiming template which you will see on this link here:
http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance
Not sure if they were covered by GISC then who are now known as FSA in order to know if this can be looked at by the Financial ombudsman service.
Write to the company anyway if they are still active, with guidance from the template letter with your own reasons, they have 8 weeks to respond, send send by recorded post to keep a check on timescales of 8 weeks, if not successful then get back to us we will then help you to the following step.
If these were not regulated/covered/under jurisdiction when you had taken out this policy there may be other options to try to reclaim this, and also the court option, but we will see if there are other ways before going here, unless you want to of course.
Good luck

Right been through my SAR and now I am wondering why lloyds have not provided a copy of my letter within this SAR, should I get in touch with them and request for a copy of my letter dated 20 April 2004 which was not supplied with my SAR? do you think its a good idea, or maybe the adjudicator may request for this, either way, but I do know what this is about, shall I just tell him???The one and only "Dizzy Di"0

Hello all !:j
This is my first post on this website, so apologies in advance...
Quick message regarding my claim with Barclays...
Here is the low down:
Total of 5 secured loans with full PPI for a total amount borrowed of £30,000.00 between 2003 and 2008. All loans have been fully repaid without failures.
I have been mis-sold the PPI, as I had sufficient cover from my employers, and I was also pushed by Barclays staff to accept PPI in order to get approval on these loans...
I have sent my first letter of complaint on September 1st, and have since received 2 letters from them, requesting more time to study my case... I have today sent another letter saying that 8 weeks had passed and unless I hear from them within 14 days with a positive outcome, I would pass my complaint to the Ombudsman...
Please let me know if I am doing the right thing and if I have any chance of recovering the PPI charges??
Any comment or advice would be extremely welcome...
Thanks a lot

Sounds like you have dealt with this perfectly. Just make sure you only give them the 14 days and then go straight to the FOS.
Seems like you have a good case. Good luck:DDS1 12/10/04

I would just leave it to the adjudicator now and see what he says.0
