I'm back with my dizzy head......:D :p , I had taken 2 strong painkillers for my stupid headache, my house is quiet again for 5 minutes.....;) ;) , so fingers crossed this headache will stay away.:D

Now I have to go through all of my lloyds SAR to dig out some info for the adjudicator, its bound to be here what he wants and then send by attachment, the date I have is until 12 November to provide what he request. (oh this is regarding my lloyds tsb credit card).

Seems to me like they are saying that you wrote to them in 2004 and they sent out a policy booklet.. post the wording on here and we can all have a go.. All my co-op ones sent a note with abbreviations on..

Just read in the very small print on the PPI policy

    Customer Enquires

We hope the insurance will meet your requirements. Any enquiry or complaint that you may have should be addressed, in the first instance, to the Claims Manager of the Scheme Administrators at the address above. Should you not be satisfied with the response, you may ask the Complaints and Advisory Department at Lloyds to review your case. If you still remain dissatisfied you may then contact the Insurance Ombudsman. The Scheme Administrators will provide the full address of these organisations and the referral of your complaint to them will not affect your rights in law.

From reading this then it has to be passed about again and again.... . I have today emailed the Ombudsman again about this and told them that I am sick of being passed from pillar to post and I want to be absolutely sure that this time its not going to be thrown back as outside jurisdiction. I have also asked if I need to do a letter stating my claim as I have one drafted if it is to the Insurer and not FIrstplus.

On the plus side it looks like this IS IN JURISDICITON.:D :D
  • Hello,

I have an enquiry regarding my PPI on a loan I took out in July 2006. I enquired about my outstanding loan balance and was shocked to see it was still virtually unchanged when compared to the original loan amount (Nat West).Upon making enquiries I was informed that my PPI had been loaded on to the original loan amount and all I had been paying for the last two and a years was the insuarnce! Is this allowed and do I have any chance of claiming any back. Please help!!

Thanks hun, I think I know what this is now but its still confusing, I had settled and remember sending them a letter to cancel the whole lot altogether because it was all paid off, but will double check through the SAR just in case, but yet they mention booklet...... , like you said.
I don't think I ever received a booket about this policy.
    Dear Mrs

There is a note on the business' computer record dated 20 April 2004 which says "LTR RECD FM CH RE PI. SNT POLICY BKLT. PI NOT CNXLD AS THIS NOT REQ BY CH."

Do you have a copy of the letter you issued in 2004 and if not can you shed any light on its contents?

Also in your correspondence you indicate that the credit card was paid off in 2004 and was not used. Is this still the case? If you currently use it, when did you recommence its use?

Please reply as soon as possible and no later than 12 November 2008.

    Yours sincerely

It is called front loading a policy. I had it done to me. As this is 2006 if you are going for the misselling of the PPI get your letter in now...and you should win if you did not understand the policy.

Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.

You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

    Looks to read

Letter received from cardholder re policy booklet. PI not cancelled as this not required by cardholder..

When did you take this out Di??
  • Hi all, this is my first post on the forum, although i've been reading and learning from it for a long while.

I have searched many threads, and have not yet found an answer, i would like to know if anyone has made a successful PPI claim against Advantage Finance Limited car finance?

But more specifically, on an agreement that started before car finance was regulated by the FOS? (Policy taken out in 2002 and settled in March 2005)

I was told years ago, when i was young, skint, foolish, and in need of a new car that i would not receive finace if i did not take out the PPI.

I'm actually a member of the Armed Forces, and therefore my wages are guaranteed, regardless of whether i am ill. This topped off with hoards of Personal Accident and Life Insurance (goes with the territory) i really don't need any payment protection.

Any information is greatly appreciated, positive responses eagerly anticipated!
  • hi have just contacted the halifax bank about a loan I had a few years ago. The PPI I had on it totalled £1617.34 . Will I be able to claim this back as it was paid off as part of my mortgage agreement. Do I have to prove it has been mis-sold cos at first they denied having any record of the loan but when I rang again with the loan details it was there.
