    Hi

I wrote to A & L yesterday to claim back 2 years worth of unwanted PPI I was advised to take. I know they have already been prosecuted and fined.
How long do these matters usually take to resolve?

    Thanks

    Hi Steffi

Just to give you an idea, I wrote to A&L on 30 October. They have still not given me any kind of response other than 'we're looking into it, sorry for the delay'. I have involved the Ombudsman now and have received their confirmation that they will investigate. My refund, if I am lucky enough to get it, will only be about £350 and my PPI was taken after being told it was not an option over the telephone in November 2006.

It seems there are lots of A&L customers getting refunds very quickly and for much larger amounts, but I thought I should let you know that that isn't the case for all of us and mine is still ongoing!
Thrilled to be DEBT-FREE as of 26.03.10 :D

    Hiya there hun

Have you also a copy of the recordings of the telephone calls ?
If not ask if you could also have a copy, they obviously have one there to check on this, but do not always take their word for it, they could be fobbing you off.

You may have to request a SAR if you've not done so already in order for them to send you a copy of the recordings, there is a template if you require this, they must supply you with everything they have on you on your account with them by 40 days of request, but there is a £10 cheque or postal order charge for this.

Have you requested a SAR yet hun? (known as a subject access request)?

You can always try by asking if they will send you a copy free first if you want to, but by a SAR request they must comply to it.;)

Even if you agreed a payment plan that should not affect your complaint if regarding PPI, there may also be other reasons, and these recordings should be of some help to you.

Let me know if you want the SAR template hunni, cheers.;)

Here below is the template for the SAR, if you decide to send the company one of these, post by recorded delivery, good luck.;) xx

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

In the first part under the Data Protection Act 1998:

Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.

For the avoidance of any and all doubt, I reiterate:

I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

You have 40 days in which to comply with this request.

This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Yours Sincerely

I received a letter from the FOS saying that my ppi case should succeed as Lloyds pressured me into the PPI and has told me that Lloyds will be writting to him with an offer of compensation. But am confused as to how it is worked out as don't want to be conned by lloyds any more.

I originally took out a loan for £8k in september 2005 with monthly (84 months precisely) of payments of £196.22 including PPI. In september 2007 I cancelled the loan and had it redone with monthly (60 months) of £168.39 with an original loan start amount of £7,620.07. Both loans had interst of 16.9% :(

The PPI works out at a single payment lump sum of £2,279.54 with interest over the period as £3,654.84. Now I was never any good at accountancy but the ombudsmen states that Lloyds have to take the original amount and work out my repayments without the PPI and restructure the loan accordingly from the start date including interest on payments I have already made and any compensation I am owed.

I was also award £200 for destress and inconvience

If any understands this and could tell me if I have any more to pay off the loan it would be much appreciated.

    thanks

Call their bluff and ask for a copy of the tape. They may just be trying to scare you into not reclaiming. It seems to be the way these firms are going these days. They think if they mess us around enough we will give up
