    Hi marshallka,
I've added the paragraph about the single premiums adding interest to the loan and that I wasn't offered a cheaper alternative, do you mind taking a look and let me know if it reads OK.

    Thanks

    Dear Sir or Madam,

    Re: Account number: XXXXXXXX

I purchased the above policy from you on 16th April 2003 but now believe that I was mis-sold this policy for the following reasons:

    · This is due to the fact that you have been fined by the FSA for failing to treat your customers fairly when selling Payment Protection Insurance and I do not believe that my policy was sold in my best interests.
    · I have sickness absence cover from my employer which covers me for 2 years sickness pay
    · I have death in service benefit from my employer which pays 2 years salary
    · This loan was a single premium loan which charged interest to the total of the loan and I was not offered a cheaper alternative

Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

    Yours faithfully,

    sparky
Its just more bullets but as you already had something in place I doubt very much they could argue. Looks great

    All the best sparky

    Hi Marshallka,
Thanks for your reply. Yes the Loan was sold by Lloyds in his local bank. We have already done one initial letter stating the he felt it was mis-sold based on verbally being told that he wouldn't get the loan without it. We addressed the letter to the main Lloyds Loan office in Peterlee but it was passed to Lloyds TSB Insurance in Wales. The reply he got said that he had no claim because firstly it was a single premium insurance policy and secondly he had "ticked the box" so had agreed to the loan. Well of course he ticked the box he wanted a loan so had no choice. The letter inferred they lloyds ALWAYS give customers the choice. Ha!! Not true. Does this letter count as the first one as it was addressed to the loan company rather than the insurance company or can we write another "first" letter to the Insurance company and start from scratch?
I had that reply too from my bank that they always give customers a choice. I would now reiterate your complaint in another letter as this is not a final response.

Why was this passed to the insurance company as if you are claiming misselling then its the actual company that sold the policy to you. This would be Lloyds as you rightly wrote to. I would take that date as your first date towards the 8 weeks for a final response. Perhaps send the letter to the insurance company with a copy of your original letter too. (send recorded delivery too so you have proof). Ask them for their final response in the matter.

Like you say, if your friend was in the forces then this is a job that is pretty safe I would say. There have been others on here in the same boat and I know a couple that have won too. Wishing you all the best and also let us know any follow ups..

Its not the stench that bothers me I like organised displays, its the watching my dogs frothing at the mouth when they hear them...(there is a stench then but not of smoke lol) ... my little one tries to bury himself in the carpet.. I don't mind organised displays but my argument is so many fireworks come into the country and are not british standard and then little shops open just for to sell these fireworks and they are not just pretty colours nowadays. They sound more like "bombs" .I am a kill joy... like i say i don't mind the organised ones but I would ban the sales in shops to the general public. God listen to me...:o I need putting down don't I:eek:
