    Postie been, Marshallka you WILL be interested in this hunni, I will add what the FOS have added in the letter about Endeavour here:

    Dear Mr & Mrs XXXXX

    YOUR COMPLAINT ABOUT ENDEAVOUR PERSONAL FINANCE (INSURANCE UNDERWRITTEN BY HAMILTON COMPANY LIMITED)

    Thank you for sending us your completed complaint form.

    I enclose a leaflet which explains how we can help to resolve complaints.
    As you will see before we can look into a complaint you must have given the business concerned a chance to put things right.

    I have looked at the credit agreement that you have supplied. It would appear that the insurance provided by Hamilton Insurance Company and generally the insurer that is responsible for the rebate.

    I have therefore sent Hamilton details of your complaint and have asked them to deal with the matter. They should issue a Final response in writing within 8 weeks of the date they hear from us.

    For your information Hamilton's address is:
    Sirs
    Hamilton Insurance Company Limited
    NUI Customer Relations Manager
    PO BOX 78
    Surrey Street
    Norwich
    NR1 3NU

    On receipt of Hamiltons final response, if you feel they have not put things right, or alternatively you have not heard from them after 8 weeks, please return the complaint form together with any supporting documentation.

    I return any papers you may have sent us as they may help when you are dealing with Hamilton.

    Well if that is the case then it in 2004 fisa could help but now they can't then I think the FSA should be looking into this now, as they regulate them now :mad:

    Was thinking of using a no win no fee solicitor I know they take 25% of claim but Iwas thinking by the time I paid a solicitor it may well amount to the same amount? any ideas which way to go here

    Called FSA they advised fos. Have called fos to explain and they said if I have new info then to send it in to them, they may not change their decision but will look at new info under same ref as previous complaint.

    My head is spinning and I don't feel very confident here. Looks like I will have to go to court.

    Brilliant news Di. Compulsory jurisdiction....:beer:

    You just need the insurance document now between you and Hamilton and not the agreement as that was between you and Endeavour..

    The courts... I would get all the info from Kaia and Marluc posts and do what they both did.. so sorry for this Dreamer if they dismiss it again.:mad:

    The point is now finding the unfair term, but I do need that other paperwork, so who would I write to about this? "End" or Hamilton?, I am getting all confused again......:o :rolleyes:

    Or is that another complaint again ? Its okay I have my dizzy head on again pmsl.

    I checked Kaias posts, her claim was below £5k so it would have gone through the small claims I think, will check Marlucs, thanks

    I am sitting down and calming down after receiving not 1 but 2 fob off letters.

    And they are both blatantly mis sold but one is hiding behind the not regulated by the FSA and the other is hiding behind they sent out the documents and that is enough.

    So I have rung the Fos and have made my complaints and got my reference numbers so I will just wait and see.

    One is a bank so is in juristiction. The other was not until 2004 and the complaint was 2003 but the FOS man said that they (the company) have a voluntary something with the FSA that means it may be looked at :confused:
