    Ding Ding Ding Round 2 Here Goes

    I received a statement in sept 08

    I pay £258.29 p/m

    £45.88 of this is ppi

    My closing balance as of sept 08 was £4918.08

    On the 20th jan 09 i pay another installment so i would have another 4 payments to come of the balance £4918.08

    The end date of this legal,criminal, theft of a loan is up in dec 2010

    Im trying to mess around with the figures and it makes no sense,

    Can any of you ppi guru's roughly work out

    A = If i cancel and get my ppi back, what the payments could be for my initial loan.

    B = if i were to cancel ppi but keep my payments at £258.29 how long would i have left on the loan.

    I wont hold anyone to these figures so your all safe :rotfl: :rotfl:

    And if your all worried about people not coming forward to this and claiming,

    Dont worry, if what im trying to achieve with the big cats pays off then it will keep you all busy :rotfl: :rotfl:

    Was your case officer as useless as mine? I don't think she was capable of crossing the road on her own.

    She was called Helen & couldn't answer a question without asking a colleague.

    So basicly they are saying that because we signed the agreement then we won't get any money back. I have also sent another letter giving them 14 days along with the letter I received from the ombudsman. I am also not very hopeful, but I am prepared to take it all the way. I will ring them on Monday to see what they have to say. I think that I should send off the forms to the ombudsman anyway, as Natilie has been told it will be 2 months before they look at her case.

    I have been passed to another case officer and have been asked to give them another 2 weeks. I have sent them another letter and enclosed the letter from the ombudsman. When I send the letters recorded delivery the woman at the post office says they are going to the RBS. So it is them I am dealing with.

    I sent my stage 1 letter off recorded delivery to Black Horse on Monday and this morning I've had a letter back from them today.

    The letter states that prior to me taking out PPi with them the adviser went through a demands and needs questionnaire with them and that they recommended the PPi to me as a result.

    Right yes they done that, but when I told them I didn't require PPi I was at no point told I had 30 days to cancel this and was forced to sign otherwise my loan application would fail. They have enclosed a copy of my loan agreement with them which shows I have signed for PPi but obviously this was only as like so many of us needed the money and had no option other than what the adviser was telling me.

    So then? Where do I go from here? Do I now send them the stage 2 letter?

    I was hoping someone might be able to give me a little advice about claiming back ppi on a loan my hubby took out with the halifax in 2006.

    when he took out the loan they told him that he had to take out the insurance because we didnt own our own house.

    They never bothered to ask if we had any other insurance, and told him that he would have to have the insurance or he wouldnt be able to haver the loan.

    Do you think it might be worth pursuing or wether we should just forget about it, any advice would be gratefully appreciated.

    I see tesco so many times just of late and it seems the case with them that they are not upholding the complaints and often taking longer than 8 weeks to look into these.

    I hope you get some where with the stage two letter and also if not the FOS. I think you are prepared for the wait but it may be worth it in the end.

    Ollie, you could request a SAR from them too which is all the information they hold on you. It may throw something up.

    You need to send another letter now to reiterate your complaint and ask them for a final response and then if you can take this to the FOS.

    What date was the loan??

    Mel, if you were not given a choice then it was most probably missold to you. ALso as this was taken out in 2006 you can then use the Ombudsman if they do not see it in you favour.

    Just take a look at the link here and see what you can add and delete from the template letter. Its always best to do your own from this. There are lots of reason on there for the misselling so pick out the ones that are applicable to yours.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.
