    I was thinking if blackhorse are a part of Lloyds and Lloyds would have been covered by FOS, could you not take the complaint to FOS:confused:

    You could call them and state sneakly that you have lost a credit agreement and wish for them to send you out a copy see what they say.

    I'm not to sure what you have carried out so far.
    I thought Blackhorse were part of LLoyds but even if they are/were then they also have to have been "appointed representatives" too at the time the loan was taken out.

    Now there be the thorn in my side. I have been waiting 9 nearly 10months to be given an adjudicator person with the financial ombudsman (FO) to look into my complaint against welcome finance. My first loan with them was in about 2003 which i topped up about 5times between 03 and 05. I realised i had ppi and asked for copies to get the ball rolling. They were unable to give me copies of the agreements also. The FO wrote to them on my behalf requesting copies of the agreements which i am entitled to. Guess what... they ignored the FO's correspondence!! The FO are taking up my complaint against them because the last loan was taken out just when they became regulated by the FSA and the last loan was made up of old loans being turned over.

    Im with a debt management programme suffering at paying installments to these thieving barstewards. According to welcome i still owe them just under 3000. I have calculated best i can using the agreements they did have copies of to calculate, they owe me in return about 3500 ppi back and that isn't including the whopping interest they drained me of usually around 40% plus the statutory interest i should get too. I rang the FO on Friday who assured me it wouldnt me much longer they said their waiting list was huge but they were now starting on complaints from early 2008. My complaint went in in March so any day. say some prayers for me. 2009 is the year i get debt free im sure of it. victory to the little people:rotfl:
    Maybe they do not have copies of your agreements and should have;). This may turn out to be the ball in your court..

    Has anyone heard of any decisions the FO have made on HFC bank or Welcome. I am awaiting 2 complaints now with them just wondered if the FO were kicking their butt or finding in their favour?? anyone

    Its cause a single premium is actually another loan to pay for the single premium and all the interest on the "other loan" is added too. You then pay interest on your single premium for the full term of the loan so cancelling only brings about a small reduction in your repayments and also a little bit of the whole amount and interest is rebated to your loan.

    They generally then redo the loan without the PPI. As it seems you did not know and was not explained properly about single premiums and how they work it seems like you have a case for misselling. I would make a complaint now.

    Just take a look at the link here and see what you can add and delete from the template letter. Its always best to do your own from this. There are lots of reason on there for the misselling so pick out the ones that are applicable to yours.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

    I have rang Tesco PF this morning. I spoke to Mr Chris Williams and asked him why my case had been passed over to Mr Glynn Rixom. he told me that he had a new job and I had been allocated a new case officer. I then spoke to Mr Rixom and he told me that it would be another 2 weeks before I would hear anything as he was dealing with case loads older than mine. I asked if he had received a letter from the ombudsman and he said no. Do you think I should copy the letter and the forms and send them off to him. He was rather nice over the phone

    Yes, it is 8 weeks since the first letter of complaint from you. ALways send everything recorded delivery too so you have a proof if you need to go to the FOS.

    Do you mean that A and L have taken over 56 days to reply to you at all and you have now sent this complaint to the FOS? If this is the case then the Ombudsman service can take months to get your case to an adjudicator. Its a pain that it takes this long (complaints are roughly taking 6 to 9 months now). Where you have seen people on here getting paid out sooner its cause they have either asked for fast track or their companies have offered "goodwill gestures" and then there is no need for the case to actually be adjudicated. Hang on in there and it will be worth it in the end.

    Tell him you were just in the process of being paid out lol....:rotfl:

    No seriously, as you have sent this complaint to the Ombudsman now you need to let the Ombudsman know everything that goes on with this. You can also copy the letters and forms and send them too.

    Its so annoying for you all this and I really feel for you. Why are they taking so long. I think they need a large fine and then they may start dealing with things in the said time.
  • I have rang the ombudsman this morning. He has advised me to send another letter to Tesco and enclose copies of the letter and forms they have sent to see if this gets things moving for me. If I do not get a satisfactory reply then the forms go off to the ombudsman
