Have just come off the phone to Tesco PF. They tell me it could be a month before I hear anything as they have a backlog of complaints. They have all my files ready and just need to make a decision. I explained that I have received a letter from the ombudsman who have also written to them. I sent my letter on the 6th Nov and the letter I received from them states they have till the 5th of Jan which will be the eight weeks deadline. Do you think should wait or get straight on to ombudsman. Or will I send another letter given them 14 days to reply0

It might be good news.;)
If they have not replied by the 5th Jan then start the ball rolling with the Ombudsman as there is a long waiting list and also send them another letter telling them this and that they still have time to resolve without the need to the Ombudsman to get involved perhaps and state your 14days then.

Hi all - hope everyone has recovered from Xmas.
Quick query - I'm going to do a response to Egg over their PPI letter and I'm wondering where the burden of proof lies in the PPI sale. They have sent me a copy of the printed control form that they have said that shows that PPI was selected by me and not pre-ticked, however, they've not sent any control forms showing what their procedures are or any proof that what they say is correct.
The second document they have provided is the CCA which includes a paragraph saying that PPI cover was selected.
During the course of the sale, they said that there would have been an online screen prompt to tell me to read the PPI terms and conditions and that a paper copy of the policy would have been sent thereafter.
In order that I can give them something more than a 'prove it' response to them, does anyone know where the onus being on them principle comes from?
Look forward to hearing from you - as usual, all advice gratefully received!!
(As an aside, it was a pleasure checking the balance of this card today as the balance is now £1,300 from £2,300 in July so I really am getting somewhere with it).Almost debt-free, but certainly even with the Banks!0 -

I was under the impression that egg on line had a pre ticked box which you had to untick if you did not want PPI. These firms make me laugh they say they send out terms and conditions but why is it we sometimes do not get them. I thought the onus was on them to prove. I would presume that they are still bluffing. Ask them to prove their case and if not you will take them to the FOS.

I do not know all the details of your case but am sure that Marshallka or Di will be on at some time today and confirm the above.

The mortgage adviser rang this morning to tell us he accidentally double booked us with someone who already had an appointment, so we are to see him this afternoon instead, wanted to get it done with but there we go.:rolleyes:

Even though I don't think we stand a chance on the sickness side with Pinnacle, they did email back and only said "please be advised, we are looking into it".

HI -the date of the PPI was from June 01 so more than 6 years ago, although I only cancelled in January as I made the determined effort to get rid of this card as quickly as I could manage.
I went down the court route with another lender and settled at the mediation stage, so I'm happy to take on Egg through the courts if the FOS won't take a look at this because of the timescales.Almost debt-free, but certainly even with the Banks!0 -

This is my first post on this fanastic site, having read about the PPi scandal in the press at the weekend we feel as though we have a case against Firstplus.
We tok out a loan in 2006 and were told that PPI was required, they did not say it was optional or that we could shop around. Do we have a good case for a refund and where do we start? Any help much appreciated.0
