    Hi Silverbird.;)

This is an option you have hun, you could now fill out a form which you can either download from the FOS site here:
    http://www.financial-ombudsman.org.uk/consumer/complaints.htm
Or ring them for an hardcopy through the post, but remember to also send a copy to A&L and inform them "I have now taken this investigation to the Financial ombudsman service in order for them to investigate, where I enclose a copy of the complaint form for your records".
This way A&L may still reconsider and hopefully they this will then go in your favour, for some this has worked, but still post to the FOS as well with copies of any correspondence.

Its up to you hun, but like I said it could even push them on a bit more.;)

Good luck, please let us know how you get on, cheers.

  • Hello again! :p

Got a response letter sorted out for Monument regarding ppi claim, seems our letter was standard response so nothing to worry about. Still going ahead with my letter asking for proof of telephone conversation, be very surprised if they come up with details of that

Barclaycard replied today, OH ticked box on application form in 2004, they have the it and will send a copy to us within 4 weeks. Also it's OH fault as he should have read the policy and decided if he was suitable and cancelled within cooling off period of 30 days. This is their final response (after just 1 letter???)

So what do I do? I still think we should fight it as OH can't remember whether or not he ticked the box on the application form from 4 years ago, plus how do we know that the tick on the box is his anyway? Have read in Barclaycard policy that self employed is covered but only if business ceased to trade and Accountants or Tax Office provides proof business has gone bust.

Do we still have a case? I do but not sure how to go about this as mis-selling e.g exclusions in policy even though they knew he was self employed.

I just feel this is going to be the case with all the creditors due to the sheer number of people trying to reclaim, I know they will try to fob us off but it's only due to reading up and learning about the new ppi regulations that started all this off by investigating our own accounts.

How does one prove they've been mis sold PPI on a personal loan?
Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional

You send the company who sold you the PPI an SAR request and enclose £10. They should then send you all the information they hold on you and the loan and PPI.

    How were you mis sold?

    Hi Toffee Penny

Just to say I have claimed, for a friend credit card PPI back on an A and L (MBNA) that was ticked for PPI and had was self employed. This went to FOS but before it was assigned to an Adjudicator A and L wrote and said they would settle:confused: got back all charges plus interest cumulative which was a nice surprise.

I would still go ahead with it. Wait until you see the original documentation. It may not cover you. They cannot hide behind their paperwork.

Let us know when you see the agreement.:D

Just looked at CC agreement I have here which am claiming back for somebody and you have to OPT OUT of the PPI with Barclaycard so yours may be the same. Good Luck
