  • wonder if someone can advise me on trying to claim payment protection. i was working fulltime for a company for over 5 years then was was made redundant then took a job for a year somewhere else but left due to conflict of interest with the owner. i went and worked for agency and have been doing so for over 9 months. i never wanted to claim dole money but due to the fact jobs are becoming obsolete in the current climate i had to claim benefits and claimed my payment protection they are saying i left my job voluntary when i never did. ive worked because i wanted to earn money and pay the bills myself rather than sit on my !!! and do nothing all day :rotfl:. so now i have to try appealing against the decision what chance do i have..

on another matter my credit card which ive had for 5 or more years i didn't realise i was paying payment protection. lol my own fault i would just quickly look at my statement and pay the bill and a few months i cancelled the proetection cos i found out what it was.. now i need it because the credit card company are constantly phoning asking when i will make a payment or i will go on some kind of payment plan.. please any advice on both or just the one will be great thanx

    Hi there and welcome.;)
Sorry to hear of your situation here.

You can request for SAR which is known as a Subject access request from employers as well as finance companies where they have all the information they have on you on data/microfiche.

I will post up the template for this in a post below when I come across it, however there is a £10 charge for this by cheque or postal order payment, they have 40 days to comply to this and please post by recorded delivery.;)

Now regarding the Credit card issue here, ask them first for a copy of the calculations so you know where you are with this, but I am sure someone will post up something for you at some point today.

You could also try to complain and reclaim on being mis sold in the first place as you did not know you had this, check this link out here:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

The link above has some useful information of ppi for loans and/or credit cardsw, check this out and if any of that occurs to you then write to them, there is also a template letter you can use as a guide, but add your own reasons and as much info as possible to back your case.
Post by recorded delivery and they have 8 weeks to respond in full, we shall then take it from there.

They may come to a good will gesture here due to what the problems your having with them at the moment.

If you require further info hun, let us know where we will be happy to help where we can.

Good luck and I will post up the SAR in another post shortly.;)

FIrstly you would have to check your terms and conditions on the policy as to whether you have a valid claim if you left the job for the reasons you state as they could say this was voluntary. Perhaps someone else could give their views here but if you can prove that you did not then I would say you have a valid reason.

Secondly on the credit card PPI are you saying you cancelled it and then you want to make a claim...?? I don't think that would be allowed unless you were out of work at the time the policy was valid.

Sorry to have not been much help but perhaps you could explain to us more about the situation...;)

The SAR as promised, but if sending to an employer, obviously delete anything financially but request for the rest for the information required, my mate done this and everything were sent, however you could still try requesting for the information without going through all this.
Now this is what you can use for your other finance issues as well which may be a big help for your case. Good luck.;)

Unless someone else can suggest another way, this method still worked for my mate regarding an employer, but if you are paying a union they maybe able to help you through this without having to go through all this.
Again regarding the employment issues there may be a thread on this site where others will be able to hopefully help and guide you here.

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

In the first part under the Data Protection Act 1998:

Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.

For the avoidance of any and all doubt, I reiterate:

I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

You have 40 days in which to comply with this request.

This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Yours Sincerely
The one and only "Dizzy Di" :D
