I was told by Cassidy Davis when I spoke to them that although the complaint about the rebate is firstly with them (as they took over from this company that liquidated) it then goes onto Lloyds and ultimately back to FIrstplus. This is what is the usual procedure I think but I think that the FOS will not listen to HFC passing it back. They will probably make them take the complaint. Just because they are saying its not them does not mean that the FOS will see it that way too.

You have had no end of messing with yours hun..... , my hubby said the same as you, he said HFC have not even admitted receiving the details from the FOS and are not going to either, they are turning a blind eye, and yes I think your right here.
I did also mention about a new complaint form to her, I prefer if they send me one with a prepared reference number on it that download online, yet I will still do a copy I suppose.

They said on the letter that I have exhausted the system but really this was the first complaint, as the other was to Endeavour which was moved on to the HFC bank as they deal with these in one now.
If you remember I wrote back when Tiggrae helped but did not get a final response, its really going round in circles again here.

I am now wondering if that is the actual response from my older letter, even though its to the same place at the end of the day...... , and by me sending them that email they realised it was still in the system from few months ago, this is why they have not had or not confirmed details from the FOS, does make me wonder.....

This was the letter dated 30 July 2008, sent to Endeavour but it was moved onto HFC bank as they work all in one now sort of thing, even though HFC as also on my documental paperwork have always been their bank.

This one they did not take any notice of and still went by an older complaint about the mis selling if you remember because I had wrote to them again and they did not even respond that is when I had then gone to the ombudsman:

    Dear Sirs

With regard to the above, upon early settlement of my loan in November 2005, I only received a small proportion of rebate against the Payment Protection Insurance, which I believe to be unfair under the Unfair Consumer Contract Terms Regulations 1999, especially considering the loan / PPI was taken over 25 years and settled only one year later

I am also aware the FSA have stated Companies should provide a fair refund upon early settlement.

Also, as only a small proportion was rebated, yet your own Marketing state, ‘if settle early you may be entitled to a refund’ in my opinion I did not receive a refund and believe this statement to be mis-leading and amounts to Negligent Misrepresentation under the 1967 Misrepresentation Act.

In summary, I do not feel I was treated fairly, should you fail to uphold my complaint by which I believe you unlawfully deprived me of approximately £3722.68, if this amount plus 8% Statutory Interest is not forthcoming, upon receive of your final response I will without further notice take my complaint to the Financial Ombudsman Service, on the grounds of an Unfair Settlement Rebate.

I look forward to receiving your response within 8 weeks of this letter.

    Yours faithfully

Yes I really think this is what happened here, so I will be filing another complaint in with the FOS, they had their chance on this ages ago.;)
