    can anyone help how far back can you go on appl claim and can you claim even if the loan has been paid

    Not too many problems in relative terms ( frightening that I consider this to be a good time financially compared to what it used to be like!)

    What's most irritating is that each and every time Sainsburys refused to accept that that OFT Guidance was even relevant. "Sorry, we're not giving you back your bank charges" being the response when it was clearly not a letter about charges! :p I'm embarrassed for them! In the time that this matter has been passed to the FOS as a complaint, there has been baout £160 accruing to it in interest which I've asked to be refunded as the account should be put on hold (as per the OFT Guidance when there is a dispute). Instead I got their daft standard charges response :mad:

    At the moment, the balance of the card is about £1380 with £160 in charges which I don't think should have been added, plus about £1,010 in PPI (which inc interest) so I'm really really keen to get a decision this as it can mean the difference between keeping hold of this card or being able to clear the balance and move into (er, almost as I've till got Egg to go!) debt-free heaven! :j

    P.S. Looking back over my file on this, I first raised this issue with Sainsburys over a year ago. Frightening.

    Good for you/ It is obviously not as desperate as I was thinking. Am glad your are getting it sorted. Hope it all gets sorted for you and good luck.:eek:

    In a broad way you can claim back for the last six years or as soon as you realised there was a problem.:D Then supposedly six years from that.

  • Evening everyone

    I had an email from the adjudicator today about the explanation of the calculations of my award from Black Horse finance. The calculations total a sum of £1379.55 which had been added to my existing agreement with them. This means, I think in theory I get nothing back because I am in arrears with the loan. I thought I would get more money than what has been calculated. BH state that any interest charged in relation to the policy is being reversed today. What does this mean? For 3 loans (albeit re-finances) dated 2005, 2006 & 2007 for the sums of £4,000, 6,500 & 10,000 this seems a small refund.

    The adjudicator states the following;

    Dear Mrs xxxx

    An explanation of the calculations carried out and the changes made to your existing loan. You should see this reflected in your account shortly.

    Quite honestly I'm gutted. I know I have been in arrears for the past 5 months but this is just a drop in the ocean. I was expecting abit more cash. I've emailed the adjudicator because I believe the sum awarded is incorrect.

    Yes. All Ive had is a letter to say they received my 1st letter and will reply in due course. Had nothing since.:confused:

  • Can I just ask if you don't have your original loan/credit card agreement or statements - do you need to get copies of them before you can send your reclaim letter ?!

    And say you have original agreement but no statements - can you send your reclaim letter - or do you need to have all the evidence first?!

    I emailed the FOS today to find out what was happening with my Sainsburys complaint and the reponse I got was '6-9 months or more if more complicated' (do you think they could tell whether it be before or after 2015?). Obviously the standard response of, "We'll put your comments on file......................bla bla bla"

    What s annoying to me is that one of the issues is that I believe that Sainsburys are in breach of the OFT Guidance on Debt Collection by reporting info about this account to 3rd parties, as well as applying interest while the account is in dispute. Despite struggling financially (because it has taken Edinburgh Council 5 years to send me the details of the sum due of the year I claimed council tax benefit - which I'm now paying at £130 extra per month for another 5 months), I'm still paying Sainsburys the minimum each month while the OFT Guidance would suggest I don't need to! Can I get them to adhere to that? Nope. 23 recorded delivery letters later and still no luck in getting them to abide by that!!!

    Sorry, not really contributng to this thread but just having a bloody-minded rant!
    You and me both then today... hope it gets there soon for you. Can you not ask for the fast track if you are financially stuck. I would but you have to send them proof. I asked but all I got was your comments have been noted etc but still worth a try...good luck

    I took a loan from hsbc in july 2004 . When signing the agreement I was told that i was actually borrowing an extra £600 on top of what I'd requested. I was informed this was a one off ppi payment which as necessary to secure the loan. I have since been told that I can reclaim this amount as I never needed the ppi and was not told it was optional. Is this right please help
    Was this one off payment £600 plus interest? Was it a single premium too??

    Yes you can make a complaint if you feel it was missold to you.

    Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

    omg !!! me and my wife sat down last night to do a budget last night. if we are are tight with money for about 2/3 years we could be Debt free!!!

    if we can do this it would end 10 years of worry! In 2/3 months this site and you guys have helped sssoooo much!

    sorry had to get that lot off me cheast!!!! got to say when i heard this news i had a little weep :o

    the next big battle is to get our autistic son the help he needs at school

    So glad for you and that you appreciate the help from the site too. I also got my tax refund from here... took about 3 months in all but worth it. :D
