PPI Reclaiming discussion Part III

I took a loan from hsbc in july 2004 . When signing the agreement I was told that i was actually borrowing an extra £600 on top of what I'd requested. I was informed this was a one off ppi payment which as necessary to secure the loan. I have since been told that I can reclaim this amount as I never needed the ppi and was not told it was optional. Is this right please help0

Hi all hope all's good. Don't know what to do
. So far i've got 3 letters form halifax. one to say they have decided to refund me ppi on one old loan, one to say they are looking in to a current loan and one to say thay are looking in to my sar report.
I posted two letters on the 27/10/08 about two old loads, one i've heard back about (see above) one i've heard nothing. do i ring halifax? thing is untill i get the sar report back i don't have any info about these loans(apart from dates and addresses)!I don't like ringing banks with out good info( I don't even know which loan ppi they are going to refund!). Sorry just feel like a 5 year old waiting for xmas hehe:o Harts telling me to ring, heads saying to wait for the SAR. :rolleyes:

Ok then i got a letter for halifax about the second old loan! although their not taking responsibility they have decided to refund me a figure to put me in the position that i have not taken out the ppi.:T No figures mentioned as yet.
I had just got off the phone to a nice lady at the tax office :eek: They are looking into a tax refund i found out on this site. :rotfl::T when my wife texted me with the news of the letter.
omg !!! me and my wife sat down last night to do a budget last night. if we are are tight with money for about 2/3 years we could be Debt free!!!
if we can do this it would end 10 years of worry! In 2/3 months this site and you guys have helped sssoooo much!
sorry had to get that lot off me cheast!!!! got to say when i heard this news i had a little weep
the next big battle is to get our autistic son the help he needs at school
bring it on !!!!!:p

dNo that is not right. Go to the Reclaim 1,000 on the red tab above and look through the information above and you will find a letter where you can re claim. Look at the bits you think may apply with you.

If I am wrong then I hold my hands up and apologise but I really believe (not just cause the method that tiggrae used says it) that they are wrong as I have calculated this by the loan and interest and then taken away the repayments made against the loan and then calculated using rule of 78 calculator and there is £500 difference on the 1999 loan. It proves that their way of redressing is under cutting the consumer.

I think it will only have to go to the ombudsman himself if the firm do not agree, the adjudicator has the opportunity to put this right for you, if yours is not correct then I would ask them how they actually worked this out if this is the case, yours is more than likely to be right though hun.;)

No it is not right. Go to the Red Reclaim 1,000 taB at top of page and have a read through there. You will find a letter to send on that page. Work out what you are going to claim for. If you need to send a SAR and ten pounds they havbe 40 days to give you that info. If you complain straight to them they have 8 weeks. It is all clear on the link.
Send your complaints etc recorded delivery so you are aware that they have received it.

This will only go to the ombudsman himself hun if the firm do not agree, with a bit of luck the adjudicator will agree which I think he will, then he will inform them of the calculations he has from you (although he may not state you passed them on to him) ,if this is not correct then they would have to prove that to the adjudicator. Yes hun the guy who emailed back was the guy the FOS given me the contact and address details for.
I emailed him back with further details, so I am hoping to hear from him tomorrow, if not then I will be in touch with the FOS consultant, then they will think I'm checking up on them......:o :rolleyes: , I only emailed them to see if the details reached them a fortnight or so ago and if its being dealt with.
The FOS said they were not allowed to send a copy of what they sent as they do not do this.......think I posted a copy of her email on here last week, so now I have not got a clue.....The one and only "Dizzy Di"0 -
Oh bless you that is !!!!. I am so sorry you are having all these problems. You are obviously in a lot of financial problems have you thought of nhallenging the actual loan. I f you are desperate it may be an option. My opinion only here.
Not too many problems in relative terms ( frightening that I consider this to be a good time financially compared to what it used to be like!)
What's most irritating is that each and every time Sainsburys refused to accept that that OFT Guidance was even relevant. "Sorry, we're not giving you back your bank charges" being the response when it was clearly not a letter about charges!I'm embarrassed for them! In the time that this matter has been passed to the FOS as a complaint, there has been baout £160 accruing to it in interest which I've asked to be refunded as the account should be put on hold (as per the OFT Guidance when there is a dispute). Instead I got their daft standard charges response :mad:
At the moment, the balance of the card is about £1380 with £160 in charges which I don't think should have been added, plus about £1,010 in PPI (which inc interest) so I'm really really keen to get a decision this as it can mean the difference between keeping hold of this card or being able to clear the balance and move into (er, almost as I've till got Egg to go!) debt-free heaven! :j
P.S. Looking back over my file on this, I first raised this issue with Sainsburys over a year ago. Frightening.Almost debt-free, but certainly even with the Banks!0
