    Its only been over a week or coming up 2 weeks then but wonder if HFC are the type to reply at an earlier stage, now its me getting impatient lol and I should give them a chance really lol...:o :D .

    I dont think they are. Ive been waiting 4 weeks so far with no reply.

    But surely the FOS can work these back by taking the loan and adding up the repayments made and checking what you paid at settlement... Its not too hard to do as there are numerous rule 78 calculators for older loans like mine. I just hope they see it like I do... at first I was going to accept (which is what most people do!!) but then I thought that I could calculate the loan alone without the PPI and this is what I did and we were charged an extra £500 more than what it works on the rule so that is my grievance on that loan and likewise on the other ones too...

    My hubby says tonite that the FOS should check these figures when they have the case... this would then stop these cases going backwards and forwards... :confused::confused:

    You can request a SAR from them and it cost you £10 and they have to supply it on 40 days so a bit of a wait but often its worth it as it most probably will have the proof you need.

    SAR - SUBJECT ACCESS REQUEST

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

    Ey!!!! Have you been back in touch with the FOS Di... Maybe it was a different department or something.. Did they give you the address of where they sent the letter and a copy etc..:confused: .

    i have complained to watchdog today about blackhorse & FLA if there's enough complaints, they will investigate, so put a complaint to them. worth trying anything that could help
    You can ring the FOS helpline and ask them straight out what date that Balck Horse became members of the GISC. When you have found out then please post it on here as there is often lots of confusion about this and it would be good to have it from the "horses" mouth so to speak. (pardon the pun)
