    Many of us have been caught in that, thinking the person on the phone seemed friendly enough, even though some have received without writing to them, but best to be safe here.

    I don't think Black Horse were covered/regulated during 2003, please remind me was it them that arranged and sold you the loan? Or a loan broker?

    I do know others though taking different routes with these if they were not covered, the ombudsman will not be able to investigate unfortunately, it seems there are loads of us here in the same situation with some of the finance companies, but some even try to FLA, the financial leasing Association here:

    It may also be worth your while emailing then to be prepared, just in case, to see what other direction you can take here, but yet with a good strong case the small claims court is another option to take and not too drastic as people think to what I am aware of.;)

    The loan was arranged directly with Black Horse. So if I went to the FLA do they charge for their services?

    No they do not charge but often don't do anything either from what I have read..:mad: .

    FLA just send what you send to them to blackhorse, they dont look at it & there's no mediation from them between the two party's to help resolve the complaint. they are a total waste of time & i sold them so, believe it or not the girl agreed who i was talking to. the advice given on here today has been bang on, if these company,s were not regulated & give you a final response, then there's no point beating around the bush, courts the only option.
    FSA gave me [community legal service]for help & advice on taking court action. tel;08453454345
    dont be put off anybody its down to these company's proove they havnt mis-sold & its not easy for them to do as you can see on the success thread.

    Shame the FLA are not able to help, makes you think why they are really there, it just doesn't seem fair does it?

    Although I am sure some have been successful from these, but it may take a bit of messing about, court would be a better option here I think, straight forward and a quicker method.;)

    No some banks (most in fact) were members of the old Banking Ombudsman Scheme which was around before the FOS so if you have a claim over 6 years old and you only just became aware of the misselling then this can be applied to your complaint. ALso if the firm was a member of the GISC. Its like the same rules as section 32 of the consumer credit act. Just depends on whether the firms were members of any of the old schemes and if you can say that you only just became aware of the misselling.

    Robbie here is some info if the amount for reclaiming is £5k and less, but I am sure there is more direct info on these issues for court.
