I would perhaps ring and ask what loan they are refunding on and also you can request copies of the agreements under section 77/78 of the CCA which may be quicker than waiting for the sar. The copy agreements have to be sent out in 12 days and all you do is write and enclose £1 for them. I would just state in the letter that you require the agreements of ANY loans you have taken out with them. Don't forget to send it recorded delivery.

Thanks for that, i did write asking for copies of the agreements on the two old loans, but they wrote back asking for account numbers:mad: thats why we went for the SAR.
didn't think about just asking for the agreements of ANY loans.:T do you know if it's £1 each? or £1 the lot? thanks mac

Will all be worth it in the end hopefully!!

Masmit - how are you getting on with Blackhorse?
    sorry robbie iv been offline
they denied mis-selling to my existing loan but didnt answer to previous loans or requests for all agreements past & present.
sent to more letters which were ignored, then i sent for a SAR. ACKNOLEDGED
have two weeks left then i will be looking at court options.
i really think this company believe's it can do what they want, from sale's to complaints, but im not going away no matter what.
good look with your dealings with them, hope its better than mine.
    will keep informed of progress.
  • Hi folks! Just posted this on success thread by mistake - oops! Here goes again..... :o
I refinanced original loan with another twice on W/wich advice & then cleared balance in full in March 2005. My monthly payment was £368.22 - £59.09 of which was PPI! About 20%! Amount borrowed was £15000. I sent first template letter & received acknowledgement ltr & questionaire.
Their "PPI Complaint Standard Questionaire" asks for details of complaint (already given on my letter), was I advised of 30 day cancellation rights,& asks for description of seller(!).

Page 2 is entitled "Questions to help us re-establish your circumstances @ time of application & when the policy was put on risk" - what does put on risk actually mean? Showing my ignorance, I know!

Also asks if similar cover existed elsewhere @ the time, name of alternative insurer, policy no & documentation! Sure that's the whole point, I wasnt advised that I had any alternatives!!
Then asks "any pertinent facts why you shouldnt have been put on cover?" - Dont understand this.

Then questions re any claims made (none in my case), if cancelled when & why, & if cancelled some time ago why do you now believe it was missold.

Sorry to be so long-winded, but I really would appreciate any comments or advice folks. Had excellent news today from A & L who are offering to repay all PPI pymts & 8% interest totalling £225 - all from one letter.:D

Thanks Martin, and everyone, for it's reading your posts that spurred me on. I have learned so much in the past few weeks through this site. xx

    Firstly congratulations on the A and L one:beer: .

As regards this other one W/Wich!!! I take it they sent out a demands and needs type form for you fill in.. Most people that have these forms are sending them back with another letter to state that this information would have been appropiate at the time of the loan but considering it is now paid up and PPI was added by being missold then how can this information be of benefit now!!.

I would just write back and reiterate your complaint and wait for their final response in the matter and then let us know.

    Its just another stalling method..

    Good luck
