    I wondered that too maxdp...although I thought they had sent a copy of it to the adjudicator some time ago...:confused: . I remember Di saying the adjudicator was saying about a letter sent to them in April..:confused: . Perhaps they were telling the adjudicator about the contents then but not having a hard copy of it?

    Good morning folks,

    I hope you don't mind but I'm looking for some advice here. As you know I have a case with the FOS re: Welcome Finance. I emailed the adjudicator who is dealing with the case and he said he is awaiting a reply from Welcome at the close of business which was last friday 7th November. I called him for an update to find out if there are grounds for mis selling. He was non commital. He basically said he reckons there are grounds for mis selling but wants to run it past his manager first and will get back to me early next week. What do you make of this? The case has been with FOS since Jan this year. The adjudicator seems ok but said he doesn't want to get my hopes up. I just want to know if his assessment upholds my complaint or not. This is very frustrating.
    Probably one of the new adjudicators perhaps and has to run it past the manager do you think?

    I have not heard of this before. They either uphold it or not..:confused: . I thought that was the whole point of the adjudicator...:confused: .

    Hi Richard.
    This will depend on the year and if the loan company were regulated and covered by either GISC prior to Jan 2005, where the FSA had taken over from there.

    But many still try anyway, I have known some to be successful and some not, however, if you want to find out more, please post on the Reclaiming discussion thread, if you click on loans first, above the page you will come across the mentioned thread.

    Myself and/or someone will be able to help you further here and confirm who you can try to reclaim from.;)

    You can write and request the old agreements from them. You may be asked for £1 to do this though so make a cheque/postal order for them. They have to provide them in 12 days too. Also send it recorded delivery too.

    I am confused as to your reasons for "getting it back though".? Are you saying these were missold to you and for what reasons.

    Was the PPI a lump sum single premium policy or a monthly payment that was cancellable at any time. If it was a lump sum payment then it would have been paid as a loan on top of your mortgage and you should have got a rebate against it if you finished the mortgage early. If it was a cancellable payment paid each month then there would be no rebate.

    Who was it that sold this to you as it was in 2001???

    You can make a complaint if you feel this was missold to you. Make sure that the complaint is against the firm that actually sold the insurance to you if this is different from the mortgage lender too.

    Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

    Hi all.

    I do tend to have the documents within the SAR just saying about PPI query April 2004 and assumed as they had this then they may have still have had the copy of the letter, yet they seems to have everything else over the years.........:confused: .
    I think the adjudicator was hoping I had this copy myself and this is why he questioned me on this 3 weeks ago, as they couldn't have had sent him anything either, only what I have about a PPI query.....:confused:

    Perhaps your right about the adjudicator he must be new at the FOS. If he reckons there are grounds for mis selling why doesn't he just say so. I hate not knowing.

    Mine was 2000 and settled 2003. I think Dreamer was 2004 although not sure of that...:D
