    Thanks dreamer33,

Received a letter from Tesco Personal Finance this am saying they are looking into my complaint and they will respond in the next 10 days with an answer or more time to look at this. So i called and asked where my documents were and i was told they are still trying to locate them.
Loans were from 2004 and 2005 both paid in full......
lets hope they can find them and pay me back whats due to me.

They should still have them from 04 and 05

    Good luck

    Hi Folks

    Hope Marshallka is okay......... .

Still not heard from the adjudicator about my lloyds tsb case, but over a fortnight ago I emailed lloyds to ask them for a copy of the letter I sent them in April 2004 about my ppi query as this was not added within my SAR a few months ago.

Anyway received a letter from lloyds today and this is what they say:

    Dear Mrs

YOUR REQUEST FOR INFORMATION UNDER THE DATA PROTECTION ACT 1998

Thank you for your email 30th October 2008, which has been forwarded to me by out Internet Banking Department.

I referred your question to our card services department, as the paperwork you mentioned was provided by their area. They advised me that the letter you sent in 2004 and their reply to it would have been held for 6 months and then securely shredded in accordance with their procedures.

This is why you did not receive these documents in your parcel of DSAR information.

I hope this answers your query but if you have any further questions please feel free to contact me.

    Yours sincerely

Di surely they should not have done this. How do they know what happened to it. If they know it was destroyed they must have known that they received it. What are they hiding.

I wonder if anyone can help me, I recently recveived a letter about my complaint from HFC bank, stating they could not ascertain whether my ppi was in my best interests, but they said i had 2 options, they would take it from my balance of the loan so i could either pay my balance in full or i could take out a new loan for the outstanding amount.

Can they do this? and do i have the right to say, no i dont want it taken off the balance i would like it in cheque form?
If you have psysically paid the money out then demand the cheque refund. I have known cases that have gone to the FOS and been upheld and they have refunded part by cheque and part by refunding to the loan if there is a balance on the loan. You could perhaps argue this with them...

Let us know how you get on..:D

To all you experts out there, if you receive a letter that is from the FOS that says they are asking the business for further information about the case does that mean it is in their jurisdiction ? Would they have checked this before approaching the company?
After all your stories I am paranoid!!
With my firstplus one and the going to two adjudicators and then being thrown back it was Firstplus who objected to the jurisdiction thing... Think they can sometimes tell the FOS that it is not in jurisdiction..

Hi, I was wondering if anyone could help and tell me whether I'm wasting my time or whether this is worth persuing further? I have a Nat West Mastercard which I have had for 20 years and has PPI cover which I don't need so chancing my arm I sent the fist template letter to them claiming mis-selling. At the time I took out the card I was considerably greener and don't recall ever being told exactly what the PPi was for. I have today received their reply basically telling me to get stuffed!!!! Has anyone sucessfully reclaimed going this far back?

I got it wrong then sorry, thought tiggrae said that seeing as it was a loan it had to be paid back into that account.
